The land is zoned "R-2" but had a commercial use on it at one time, and nonconforming status for "C-3" uses. The owners assumed that the site was zoned for any type of commercial use and leased the property to the current user, an auto sales lot. There is one building on the two acres that is being used as the office and the area adjacent to the 1-30 frontage road is being used for display. The rear portion of the acreage has nothing on it at this time. On the north side of 1-30, all the land is still zoned "R-211. A rezoning request ("C-4" and "1-2") has been acted on by the Planning Commission for 12.6 acres to the east and north. However, the rezoning has not been finalized by the Board of Directors because the dedication of additional right-of-way has not been completed. South of 1-30, the existing zoning is "R-2" and "1-2". Land use found on both sides of 1-30 is either residential or industrial. A high percentage of the land is still undeveloped and directly west of the property under consideration, there is a cemetery. November 14, 1989 Item No. 6 - Z-5255 (Continued) The Otter Creek District Plan suggests a "mixed office/ commercial" pattern for the north side of 1-30. Staff feels that a 11C-4" reclassification is compatible with the plan's direction and supports the request. The acreage to the east will be zoned 110-4" once the right-of-way dedication is completed, so the proposed rezoning is consistent with other actions in the area. Over the years, the City has endorsed a zoning configuration of "C-3", 11C-4" and "1-2" for the properties that front 1-30. Therefore, the proposed zoning change is in keeping with established policy for the 1-30 corridor. The only issues associated with the request have to do with site improvements and the "C-4" development criteria. If the property is rezoned to "C-411, landscaping will be required and the area being used for display of vehicles will need to be paved. Also, any servicing of vehicles shall be done within an enclosed building. ENGINEERING COMMENTS: Dedication of additional right-of-way will be required for Sibley Hole Road because the existing right-of-way is deficient. STAFF RECOMMENDATION: Staff recommends approval of the 11C-4" rezoning as filed. PLANNING COMMISSION ACTION: (November 14, 1989) The applicant was present. There were no objectors and the item was placed on the consent agenda. A motion was made to recommend approval of the 11C-4" rezoning request. The motion was approved by a vote of 11 ayes, 0 nays and 0 absent. 2
