HomeMy WebLinkAboutZ-5252 Staff AnalysisNovember 14, 1989 Item No. 5 - Z-5252 Owner: Lynton Egbosimba Applicant: Same Location: 2608 South Maple Request: Rezone from "R-3" to "C-3" Purpose: Commercial Size: 0.13 acres Existing Use: Single family SURROUNDING LAND USE AND ZONING: North - Vacant, zoned "R-3" South - Commercial, zoned "C-3" East - Single family, zoned "R-3" West - Single family, zoned "R-3" STAFF ANALYSIS: The req-uest is to rezone one residential lot on South Maple Street from "R-3" to "C-3" for some type of commercial use. The site is located just north of Asher Avenue and has a 1,049 square foot residence on it. There are no accessory buildings and the property is typical of other residential lots in the neighborhood. Zoning in the area is a mix of residential and nonresidential districts that include "R-3", "R-411, "C-3" and "1-21'. A majority of the commercial and industrial zoning is found between Asher Avenue and West Roosevelt, but there is some "C-3" and "1-2" on the north side of Asher Avenue. The lot under consideration adjoins "C-3" property along the south property line. The land use pattern conforms to the existing zoning in the area. There is a possible exception and that is a large "1-2" area on the south side of Asher which is a combination of -commercial and industrial uses. Also found in the vicinity are two public uses, Garland School and offices for the State Police. On the adopted Stephens School Land Use Plan, the lot is identified for mixed use as is the entire block. The mixed use areas are to provide locations for a blend of office uses and various levels of commercial services and in some instances, light industrial use. Because of the plan and November 14, 1989 Item No. 5 - Z-5252 the property's position in relationship to Asher Avenue, staff feels that a commercial reclassification is a reasonable option for the lot. The site does have visibility from Asher and it appears to have been impacted by the "C-3" to the south. To avoid the possibility of impacting other lots and to provide some transition from Asher to the residential lots, staff suggests that "C-1" is a more appropriate classification for the property. The "C-1" District provides for neighborhood type uses and helps maintain the plan's concept for the mixed use areas. ENGINEERING COMMENTS: None reported. STAFF RECOMMENDATION: Staff recommends approval of "C-1" and not "C-3" as requested. PLANNING COMMISSION ACTION: (November 14, 1989) Lynton Egbosimba, the owner, amended the request to "C-1" and the issue was put on the consent agenda. A motion was - made to recommend approval of "C-1" as amended. The motion passed by a vote of 11 ayes, 0 nays and 0 absent. 2
