Strickland 9104 Geyer Springs Road Rezone from "R-2" to "C-3" Commercial 0.73 acres Existing Use: Single family SURROUNDING LAND USE AND ZONING: North - Vacant, zoned "R-2" South - Office, zoned "0-3" East - Mobile home park, zoned "R-2" West - Single family, zoned "R-2" STAFF ANALYSIS: The request before the Commission is to rezone 0.73 acres on Geyer Springs Road from "R-2" to "C-3" for an unspecified commercial use or uses. The property is situated at the northwest corner of Geyer Springs Road and Senate Drive, approximately 600 feet south of Baseline Road, and has 176 feet of frontage on Geyer Springs Road. Located on the lot is one single family residence with an accessory building in the northwest corner of the property. Zoning in the general vicinity includes "R-2", 110-111, "0-311, "C-1", "C-3" and "C-4". The property abuts "R-2" zoning on two sides and across Geyer Springs Road, the zoning is "R-2". To the south, the existing zoning is "0-3". At this time, a majority of the commercial zoning is located at Baseline and Geyer Springs, with the exception of a "C-1" tract at the corner of Geyer Springs Road and Queensboro Drive. Land use is a mix of residential, office, commercial, a church and two schools - one public and the other private. The existing residential uses found in the neighborhood are single family subdivisions, multifamily units and a mobile home park. Several of the uses are nonconforming, including the mobile home park and some of the nonresidential uses at the southeast corner of Baseline and Geyer Springs Road. 1 November 14, 1989 Item No. 3 - Z-5238 (Continued) When the southwest corner of Baseline and Geyer Springs was rezoned to "C-311, a 50 foot "R-2" strip was left along the south property line to buffer the existing single family uses to the south. By leaving the "R-2" buffer, a conscious effort was made to stop the commercial zoning to the north of 9104 Geyer Springs Road and to protect the integrity of the single family neighborhood. Rezoning the property in question would create an undesirable zoning pattern and, also, the proposed commercial reclassification violates the Geyer Springs West Land Use Plan which establishes the commercial line to the north. Other negative considerations associated with this request are: the precedent for strip zoning on both sides of Geyer Springs and the possible adverse impact on the existing residential uses. ENGINEERING COMMENTS: Geyer Springs Road is classified as a minor arterial. It appears that dedication of additional right-of-way will be required because the existing right-of-way is deficient. STAFF RECOMMENDATION: Staff recommends denial of the "C-3" rezoning request. PLANNING COMMISSION ACTION: (November 14, 1989) The applicant, Carroll Strickland, was present. There were no objectors. Mr. Strickland said that he was representing his mother-in-law and described the property. He said he was surprised with the staff's recommendation and indicated that the buffer to the north was only 20 feet. Mr. Strickland went on to say that there was a drainage ditch to the west that could function as a buffer, and to the east, there would be a five -lane road in the future. Because of the property's location, Mr. Strickland felt that there was no reason not to rezone the property. He said it was a logical site for commercial zoning and indicated that he would consider office as a last resort. He then responded to several questions and said that fast food outlets have expressed an interest in the property. Comments were offered by some of the Commissioners about various issues. Mr. Strickland also spoke and said that there was no justification for denying the "C-3" rezoning. The motion failed and the rezoning was denied. After some discussion, a second motion was then made to expunge the vote on the "C-3" request. The motion was approved by a vote of 11 ayes, 0 nays and 0 absent. Mr. Strickland then amended the request to "0-3" and staff endorsed an 110-3" classification for the property. A motion was made to recommend approval of the 110-3" rezoning as amended. The motion passed by a vote of 10 ayes, 1 nay and 0 absent. 3
