HomeMy WebLinkAbout16013 1 RESOLUTION NO. 16,013 2 3 A RESOLUTION TO EXTEND THE THIRD STREET TEMPORARY 4 ENTERTAINMENT DISTRICT, FOR APPROXIMATELY FIFTEEN (15) 5 CONSECUTIVE WEEKS STARTING ON JUNE 6,2023,AND ENDING ON 6 SEPTEMBER 12,2023; AND FOR OTHER PURPOSES. 7 8 WHEREAS, on July 23, 2019, the Board of Directors of the City of Little Rock, Arkansas, passed 9 Little Rock, Ark., Ordinance No. 21,761, as amended, which permitted the creation of a Temporary 10 Entertainment District pursuant to Arkansas State Law and City Ordinance; and, 1 I WHEREAS, the City Board of Directors has determined the creation of a Temporary Entertainment 12 District as proposed by Ordinance No. 21,761 as amended is appropriate as recommended by the Planning 13 & Development Department; and, 14 WHEREAS,the City Board of Directors adopted in Resolution No. 15,496 (July 6, 2021), the Third 15 Street Entertainment District as a Temporary Entertainment District providing days and hours of operation 16 to be July 7, 2021,and October 6,2021, from 11:00 AM to 10:00 PM; and, 17 WHEREAS, the City Board of Directors adopted in Resolution No. 15,556 (November 2, 2021), the 18 Third Street Entertainment District as a Temporary Entertainment District providing days and hours of 19 operation to be November 3, 2021, and January 31, 2022, from 11:00 AM to 10:00 PM; and, 20 WHEREAS, the City Board of Directors adopted in Resolution No. 15,616 (February 15, 2022), the 21 Third Street Entertainment District as a Temporary Entertainment District for approximately thirteen (13) 22 weeks starting on February 15, 2022, and ending on May 17, 2022, Sunday through Saturday from 1 1:00 23 AM to 10:00 PM; and, 24 WHEREAS, the City Board of Directors adopted in Resolution No. 15,822 (October 15, 2022), the 25 Third Street Entertainment District as a Temporary Entertainment District for approximately thirteen (13) 26 weeks starting on November 15, 2022, and ending on February 14, 2023, Sunday through Saturday from 27 11:00 AM until 10:00 PM; and, 28 WHEREAS, the City Board of Directors adopted in Resolution No. 15,905 (February 21, 2023), the 29 Third Street Entertainment District as a Temporary Entertainment District for approximately thirteen (13) 30 weeks starting on February 22, 2022, and ending on May 22, 2023, Sunday through Saturday from 11:00 31 AM until 10:00 PM; and, 32 WHEREAS, on May 16, 2023, the City of Little Rock has received an application to extend the 33 Temporary Entertainment District for approximately fifteen(15)weeks starting on June 6,2023,and ending 34 on September 12, 2023, Sunday through Saturday from 1 1:00 AM until 10:00 PM. [Page 1 of 21 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 2 OF LITTLE ROCK,ARKANSAS. 3 Section 1. The Third Street Temporary Entertainment District is hereby extended by the City of Little 4 Rock as a Temporary Entertainment District on Tuesday, February 21,2023,and subject to Ordinance No. 5 21,761 as amended and its defined terms. 6 Section 2. Boundaries. The Third Street Temporary Entertainment District boundaries are particularly 7 described as 2nd Street and River Market Avenue to Cumberland Street on the north to 4`h Street and River 8 Market Avenue to Cumberland Street at the south. 9 Section 3. Timeframe. The Third Temporary Entertainment District shall be designated as a 10 Temporary Entertainment District upon the adoption of this resolution and shall expire after approximately 11 fifteen(15)consecutive weeks, starting on June 6, 2023, and ending on September 12, 2023. The hours of 12 operation for the Third Street Temporary Entertainment District are from 11:00 AM - 10:00 PM, Sunday 13 through Saturday. The City reserves the right to amend boundaries and hours of operation at its sole 14 discretion. 15 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 16 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 17 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 18 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 19 resolution. 20 Section 5. Repealer.
