HomeMy WebLinkAbout16011 1 RESOLUTION NO. 16,011 2 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO. 4 15,518 (AUGUST 3, 2021), LITTLE ROCK, ARK., RESOLUTION NO. 5 15,524 (AUGUST 17, 2021), LITTLE ROCK, ARK., RESOLUTION NO. 6 15,662 (APRIL 5, 2022) AND LITTLE ROCK, ARK., RESOLUTION NO. 7 15,783 (SEPTEMBER 6, 2022), TO CHANGE THE ALLOCATIONS FOR 8 THREE (3) PRIMARY INTENDED USES OF A PORTION OF THE 9 FIRST TRANCHE AND ONE (1) PRIMARY INTENDED USE OF A 10 PORTION OF THE SECOND TRANCHE OF THE CITY OF LITTLE 11 ROCK, ARKANSAS, ALLOTMENT OF LOCAL FISCAL RECOVERY 12 FUNDS THROUGH THE AMERICAN RESCUE PLAN ACT; AND FOR 13 OTHER PURPOSES. 14 15 WHEREAS,on August 3, 2021, the Board of Directors of the City of Little Rock, Arkansas ("City") 16 adopted Little Rock, Ark., Resolution No. 15,518 and established allocations for the primary intended 17 uses of a portion of the first tranche of American Rescue Plan Act ("ARPA") Local Fiscal Recovery 18 Funds, for appropriate purposes; and, 19 WHEREAS, the City has also received, and has on deposit, approximately Eighteen Million, Eight 20 Hundred Thousand Dollars ($18,800,000.00) in the second tranche of the allotment of Local Fiscal 21 Recovery Funds through ARPA; and, 22 WHEREAS,administrative costs have not been as high as originally predicted; and, 23 WHEREAS, on December 23, 2022, the U.S. Congress enacted the State, Local, Tribal, and 24 Territorial Fiscal Recovery, Infrastructure, and Disaster Relief Flexibility Act as an amendment to the 25 Fiscal Year (FY) 2023 Omnibus Appropriations Bill (`'ARPA Amendment"), which provides additional 26 flexibility for the Coronavirus State and Local Fiscal Recovery Fund authorized by ARPA, including 27 infrastructure,community development and disaster response;and, 28 WHEREAS, the ARPA Amendment allows ARPA Local Fiscal Recovery Funds to be utilized 29 toward providing emergency relief from natural disasters or the negative economic impacts of natural 30 disasters, including temporary emergency housing, food assistance, financial assistance for lost wages or 31 other immediate needs; and, 32 WHEREAS, as such, this resolution will allow funds to go towards disaster relief relative to the 33 March 31,2023, EF-3 tornado in the City of Little Rock and for cost associated with the tornado; and, [Page 1 of31 1 WHEREAS, a total of Five Hundred Thousand Dollars ($500,000.00) will be made available for the 2 City's 25% FEMA match for costs associated with the tornado; and, 3 WHEREAS, an additional Thirty-Seven Thousand, Six Hundred Fifty Dollars ($37,650.00) will be 4 made available for disaster relief associated with the tornado; and, 5 WHEREAS, instead of spending ARPA Funds for Food Desert Involvement, ARPA Funds will be 6 spent on employee salaries, and General Fund Dollars will be set aside in a Special Project Account for 7 Food Desert Involvement. Reclassifying the Food Desert Involvement Dollars in a Special Project 8 Account provides for additional flexibility in spending the funds to address Food Deserts. 9 NOW,THEREFORE,BE ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF 10 LITTLE ROCK,ARKANSAS: 11 Section 1. Section 6 of Resolution No. 15,518 (August 3, 2021) is hereby amended to state the intent 12 of the Board of Directors that administrative costs in the amount of Six Hundred Five Thousand Dollars 13 ($605,000.00) be decreased by One Hundred Seven Thousand, Two Hundred Ninety-Two Dollars 14 ($107,292.00) to Four Hundred Ninety-Seven Thousand, Seven Hundred Eight Dollars ($497,708.00) so 15 that the One Hundred Seven Thousand, Two Hundred Ninety-Two Dollars ($107,292.00) may be 16 repurposed as an Expenditure of Lost Revenue on Governmental Services for costs associated with the 17 March 31, 2023, EF-3 tornado. 18 Section 2. Section 7 of Resolution No. 15,524 (August 17, 2021) is hereby amended to state the 19 intent of the Board of Directors that administrative costs in the amount of Three Hundred Twenty-Nine 20 Thousand, Eight Hundred Ninety Dollars ($329,890.00) be repurposed in its entirety as Lost Revenue for 21 Government Services for costs associated with the March 31,2023, EF-3 tornado. 22 Section 3. Section 1 of Resolution No. 15,662 (April 5, 2022) is hereby amended to decrease the 23 total amount of expenditures for COVID Mitigation and Prevention from Three Hundred Thousand 24 Dollars ($300,000.00) to One Hundred Ninety-Nine Thousand, Five Hundred Thirty-Two Dollars 25 ($199,532.00) in order to repurpose Thirty-Seven Thousand, Six Hundred Fifty Dollars ($37,650.00) for 26 disaster relief under the Lost Revenue for Government Services category and to repurpose Sixty-Two 27 Thousand, Eight Hundred Eighteen Dollars ($62,818.00) under the Lost Revenue for Government 28 Services category for costs associated with the March 31, 2023, EF-3 tornado. 29 Section 4. Section 3 (g) of Resolution No. 15,783 (September 6, 2022) is hereby amended to state 30 the intent of the Board of Directors that the One Million Dollars ($1,000,000.00) to address the problem 31 of Food Deserts will instead be spent on employee salaries. 32 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 33 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 34 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and (Page 2 of 31 I effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 2 ordinance. 3 Section 6. Repealer.
