3 A RESOLUTION REQUESTING CENTRAL ARKANSAS WATER TO
4 PARTICIPATE IN THE EXTENSION OF WATER SERVICE FOR
5 ECONOMIC DEVELOPMENT PURPOSES AT THE PORT OF LITTLE
6 ROCK,ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS, the Little Rock Port Authority recently purchased land for economic development
9 purposes and has recently recruited an international industry to the site;and,
10 WHEREAS, this property is currently without water service and the industry will need the service
11 extended to the site in order to construct and operate the facility;and,
12 WHEREAS, the Little Rock Port Authority owns lands adjacent to the property in question and will
13 continue to attract manufacturing to the area; and.
14 WHEREAS,the Consolidation Agreement that created Central Arkansas Water has two(2)provisions
15 for extending water service to unserved areas of Little Rock and North Little Rock; and,
16 WHEREAS, one provision for providing water service to unserved areas is Section 5.04 of the
17 Consolidate Agreement that reads "the Commission may contribute an amount not to exceed 1% of the
18 Consolidated Entity's annual revenues"for economic development purposes;and,
19 WHEREAS,the other provision for providing water service to unserved areas is Section 5.07 of the
20 Consolidated Agreement that reads"at the request of the Little Rock Board of Directors ... as appropriate
21 ... make water service available to residents of newly annexed or unserved areas of Little Rock.'
22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
23 LITTLE ROCK PORT AUTHORITY:
24 Section 1. The City of Little Rock Board of Directors authorizes the City Manager and the Mayor to
25 formally request that Central Arkansas Water participate in the extension of water service to serve an
26 economic development project at the Port of Little Rock.
27 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
31 resolution.
32 Section 3. Repealer. All laws ordinances resolutions or parts of the same that are inconsistent with the
33 provisions of this resolution are hereby repealed to the extent of such inconsistency.
