3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH ESCAMILLA EXCAVATING, LLC, IN AN
5 AMOUNT NOT TO EXCEED ONE HUNDRED FORTY-EIGHT
6 THOUSAND, THREE HUNDRED TWENTY-SEVEN AND 80/100
7 DOLLARS($148,327.80),FOR THE MIDLAND STREET AT LEE AVENUE
8 DRAINAGE IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES.

10 WHEREAS, Resolution No. 15,524 (August 17, 2021), as adopted by the Little Rock Board of
1 1 Directors, made a Three Million Dollar ($3,000,000.00) allocation of American Rescue Act Funds for
12 Water and Sewer Infrastructure Improvement Projects;and,
13 WHEREAS, Resolution No. 15,603 (January 4, 2022), as adopted by the Little Rock Board of
14 Directors, identified currently designed, eligible projects in Wards 1, 3 and 7, including drainage
15 improvements on Rebsamen Park Road and Midland Street;and,
16 WHEREAS,bids were solicited for the Midland Street at Lee Avenue Drainage Improvement Project,
17 Bid No.2099;and,
18 WHEREAS, Escamilla Excavating, LLC, submitted the lowest responsive, responsible bid meeting
19 specifications of the seven(7)bids received.
20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The City Manager is hereby authorized to execute an agreement with Escamilla Excavating,
23 LLC,for the Midland Street at Lee Avenue Drainage Improvement Project in an amount not to exceed One
24 Hundred Forty-Eight Thousand, Three Hundred Twenty-Seven and 80/100 Dollars ($148,327.80), which
25 is the base bid amount of One Hundred Twenty-Three Thousand, Six Hundred Six and 50/100 Dollars
26 ($123,606.50), plus 20%contingencies.
27 Section 2. Funding for this project is from the State and Local Fiscal Recovery Fund (SLFRF)Grant
28 authorized by the American Rescue Plan Act (ARPA), as authorized by Resolution No. 15,524, Account
29 No. G0506AR40C.
30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
33 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
34 resolution.

1 Section 4. Repealer. All laws,ordinances, resolutions, or parts of the same,that are inconsistent with
2 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
