AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED ACTS CHURCH
REVISED SHORT -FORM PCD (Z- 7105 -B), LOCATED ON
THE SOUTHWEST CORNER OF WEST 42ND STREET
AND JOHN BARROW ROAD, LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING MAP
OF THE CITY OF LITTLE ROCK; AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK,ARKANSAS.
SECTION 1. That the zoning classification of the following described property be
changed from 0-3 and PCD to PCD:
Lots 5 and 6, Block 161 John Barrow Addition to the City of Little Rock,
Pulaski County, Arkansas, less and except a tract of land situated in Lots 5
and 6 Block 161 John Barrow Addition to the City of Little Rock, being
more particularly described as follows: Beginning at the SE Corner of
said Lot 5; thence N88 018'41 "W along the south line of Lot 5 27.63 feet;
thence along the proposed West right of way line of John Barrow Road
N00 049'45 "E, 66.27 feet and N01040'15" E, 31.83 feet to the north line of
said Lot 6; thence S 88 °19'45" E, along said North lot line, said line also
being the South right of way line of West 43rd Street, 27.16 feet to the NE
corner of said Lot 6; thence S00 049'45" W, along the existing right of way
line of John Barrow Road, 98.11 feet to the point of beginning; said tract
containing 0.062 acres, more or less. AND Lot 1R, Block 162 John
Barrow Addition, being a replat of Lots I — 6 Block 162, John Barrow
Addition to the City of Little Rock, Pulaski County, Arkansas.
SECTION 2. That the approval of the ACTS Church Revised Short-form PCD
(Z- 7105 -B), located on the Southwest corner of West 42nd Street and John Barrow Road
is subject to compliance with the following additional conditions:
• That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report.
SECTION 3. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for ACTS
Church Revised Short-form PCD (Z- 7105 -B), located on the Southwest corner of West
42nd Street and John Barrow Road is conditioned upon obtaining a final plan approval
within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of
Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 7. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
