Brown 1-430 & Baseline Road Rezone from "R-2" to "C-3" Outside amusement 13.8 acres Existing Use: Residential and storage for boats SURROUNDING LAND USE AND ZONING: North - Vacant, zoned "R-2" and "1-2" South - Vacant, zoned 11R-2" East - Single family, zoned "R-2" West - 1-430 right-of-way, zoned "R-2" STAFF ANALYSIS: .................. ......... The request is to rezone 13.8 acres on Baseline Road at 1-430 from "R-2" to "C-3." The proposal is to develop the acreage for outside commercial amusement which is a conditional use in the "C-3" District. (It is the staff's understanding that a conditional use permit and supporting site plan will be filed for the October 31, 1989 Planning Commission public hearing.) Uses that are proposed for the development will include two miniature golf courses, an enclosed arcade building, a batting cage, a picnic area and a driving range. The applicant has stressed that the facility will not be a carnival type environment or amusement park with rides and midway games. "R-2" is the prevalent zoning with the exception of an 111-2" area located on the north side of Baseline Road adjacent to 1-430. The land use includes several single family units, an industrial operation, and the Arkansas Highway and Transportation Department's sign shop. The majority of the land is vacant, especially on the west side of the interstate where there is a substantial floodplain and floodway involvement. The property in question is being used for boat storage and there is a small residence on the western half. 1 December 12, 1989 Item No. C - Z-5228 {Cont.inued) A 11C-3" reclassification of the site conflicts with the adopted Otter Creek Land Use Plan which shows a large area south of Baseline Road for multifamily development. Because of the Plan and other concerns, staff does not support the proposed commercial rezoning effort. We are of the opinion that the site is not a viable "C-3" location and the rezoning, if granted, could establish undesirable precedent for the area such as stripping out Baseline Road. Access, or the ability to get to the property, is another factor that makes the site a questionable commercial location. The Commission must also keep in mind that the issue is a "C-3" rezoning and not a reclassification for a specific use, so there is no guarantee that the site will be developed for the proposed use. The land use plan provides for adequate commercial growth throughout the district, and the recommended areas on the plan should be developed first before additional commercial land is added. ENGINEERING COMMENTS: Baseline Road is classified as a principal arterial which - has a right-of-way standard of 110 feet, or 55 feet from the center line. The existing right-of-way is deficient, so dedication of additional right-of-way will be required. STAFF RECOMMENDATION: Staff recommends denial of the "C-3" rezoning. PLANNING COMMISSION ACTION: (October 3, 1989) Staff reported that the applicant had submitted a request for deferral to the December 12, 1989 meeting. The item was placed on the consent agenda and deferred to the December 12, 1989 hearing. The vote was 8 ayes, 0 nays and 3 absent. PLANNING COMMISSION ACTION: (December 12, 1989) The item was placed on the consent agenda for withdrawal without prejudice as requested by the applicant. A motion was made to withdraw the rezoning without prejudice. The motion was approved by a vote of 11 ayes, 0 nays and 0 absent. RQ
