justification: Applicant's Statement: Our
proposed site is zoned as C-3
General Commercial District, which
allows a maximum height of 35' to
the average height of a sloping
"flat" roof. We are requesting
approval to construct a three story
building with a 50' approximate
height to the top stair and
mechanical penthouses.
Our client requires approximately
20,000 S.F. Because of the
extremely unusual lot configuration
a two story structure, which would
require a larger building
footprint, would reduce available
on-site parking below City
requirements. The proposed three
story structure allows our client
to exceed parking requirements by
taking advantage of the most
efficient portion of the lot. The
proposed building is setback an
additional 15' beyond the required
25' setback for C-3 properties.
Although this project does not
qualify for the height exceptions
allowed by Section 136-156(b)(1)

following them in spirit.

Staff Report
A. Public Works Comments:
1. A grading permit will be required for this development.
2. Stormwater ordinance applies to this development.
3. Repair any curb and gutter and sidewalk in the right-of-
way.
4. Appropriate wheelchair accessible ramps per ADA standards
are required for this development.
5. Driveways shall comply with City Ordinance Sec. 31-210.
B. Staff Analysis:
The applicants propose to construct a 20,000 square foot,
three story bank and office building on the C-3 zoned lot
located at 11525 Financial Centre Parkway. The lot is
located at the southeast corner of Financial Centre Parkway
and Autumn Road, in front of Pinnacle Point Hospital. The
proposed building will have a total height of 50 feet to the
top stair and mechanical penthouses. This means the
building would actually have a height of something over 40
feet as defined by the Ordinances. Such items as stairwells
and mechanical penthouses are typically not included when
calculating a building's height. The C-3 zoning district
has a height limitation of 35 feet.
Staff believes this minor height variance request to be
reasonable. The building is to be located on a 1.4+ acre
tract and is situated as to exceed all setback requirements.
The height difference will be negligible to the passerby. A
proposed three story building would not be out of character
with development in the area. The Pinnacle Point Hospital
located directly adjacent to this site is a 4 story
building. The 9 story Embassy Suites just to the east is
nearing completion. A recently completed 5 story office
building is located across Autumn Road, to the west.
Development of the site will have to comply with all other
applicable codes and regulations, including the
Chenal/Financial Centre Design Overlay standards.
C. Staff Recommendation:
Staff recommends approval of the requested height variance
subject to compliance with the following conditions:

2. Development of the site is to comply with all other
applicable codes and regulations, including the
Chenal/Financial Centre Design Overlay standards.
BOARD OF ADJUSTMENT:
(AUGUST 25, 1997)
Brad Chilcote was present representing the application. There
were no objectors present. Staff presented the item and a
recommendation of approval, with conditions.
Mr. Chilcote stated that he understood staff's recommendation and
the conditions.
The question was called and a vote taken on the variance request
subject to compliance with the conditions noted in the staff
recommendation. The vote was 8 ayes, 0 noes and 1 absent,
approving the variance.
