Conditional Use Permit (Z-5202)
Location: The southeast corner of Polk
Street and Asher Avenue
(5419 Asher Avenue).

PROPOSAL:
To obtain a conditional use permit which would allow the
conversion of an existing 5,045 square foot commercial
building for the installation of rebuilt automobile engines
on 0.41 +/- acres of land that is zoned "C-3."
ORDINANCE DESIGN STANDARDS:
1. Site Location
Adjacent to a principal arterial (Asher Avenue) and a
residential street (Polk Street).
2. Compatibility with Neighborhood
The site is abutted on three sides by commercial uses
and with single family uses located across an alley to
the south (rear yard relationship). There is an
existing screening fence and a few small trees located
on the south property line. The screening, as well as
the 20 foot alley (not used), and the rear yard
relationship of the adjacent single family help to
limit any impact the commercial use might have. The
commercial strip along Asher Avenue has existed for
many years. No additional adverse impact should result
from the proposed use.
3. On -Site Drives and Parking
The site contains two 40 foot access drives (Polk
Street and Asher Avenue) as well as 14 paved parking
spaces.

4. Screening and Buffers
The site contains an existing screening fence as well
as a few small trees along the south property line.
5. Analysis
The Staff feels that the conversion of the existing
commercial building from a nonconforming brake repair
facility to a rebuilt motor installation service will
have little impact on the surrounding area (see
note #2). The site contains 14 parking spaces as well
as room for 12 vehicles inside the building, for a
total of 26 spaces. The ordinance requires 25 parking
spaces. The applicant will need, however, to submit a
revised site plan to include a landscaped strip
parallel to Asher Avenue.
6. City Engineer Comments
(1) Repair damaged sidewalk ramp on the west end of
the Asher driveway apron.
(2) Install a curbed, landscaped island between the
parking lot and Asher Avenue.
7. Staff Recommendation
Approval, provided the applicant agrees to submit:
(1) a revised site plan as previously outlined; and
(2) comply with City Engineer Comments numbered 1
and 2.
SUBDIVISION COMMITTEE REVIEW:
The applicant was present and agreed to comply with the
Staff's recommendations. It was determined that the
landscaped strip should be three feet in width. The Staff
further stated that, technically, a five foot rear yard and
a 21 foot street side (Polk) variance would be required for
the existing building.

PLANNING COMMISSION ACTION:
The applicant was present. There were no objectors. The
applicant stated that he felt that the three foot landscape
requirement might cause�a maneuvering problem for wreckers
due to the reduced parking area. A brief discussion ensued.
Staff stated that the applicant could reorient the front
parking area (on Asher Avenue) to a 450 angle. Staff also
stated that the 450 angle parking would necessitate the loss
of one parking space but that the site would still meet
ordinance parking requirements. The Commission votes
8 ayes, 0 noes and 3 absent to approve the application with
the three foot landscape strip parallel to Asher Avenue.
