"c=3'"' area to the land st i 1 l The site under consideration is surrounded by zoned "R -4s" M .july 11, 1989 Item No. 2 - Z-5191 (Continued) Rezoning 7.7 acres out of the total ownership of 20 acres to "1-2" is not an issue because the Otter Creek District Plan identifies the area on the south side of Stagecoach Road for light industrial uses. Staff feels that an "1-2" reclassification is appropriate for the proposed land use pattern and supports the request. The remainder of the tract is shown to be in the floodway and identified as floodway on the survey. When the owner filed the application, he submitted a survey for the total ownership of 20 acres which includes the floodway but indicated that he only wanted the area outside the floodway to be reviewed. Since the 20 acre tract is under one ownership and represented on one survey, Staff is taking the position that the entire acreage needs to be part of the request being considered. Because of this, Staff is recommending that the floodway area of 12.3 acres be rezoned to "OS" and dedicated to the City which is in Keeping with the Board of Directors' policy (Ordinance No. 15,435) regarding floodways. The floodway cannot be developed and some of it is shown on the Master Parks Plan as Priority Two Open Space. ENGINEERING COMMENTS: Stagecoach Road (Arkansas State Highway No. 5) is classified as a minor arterial which has a right-of-way standard of 90 feet. The existing right-of-way of 60 feet is deficient, so dedication of additional right-of-way will be required. Dedication of the entire floodway through the rezoning action. STAFF RECOMMENDATION: Staff recommends approval of 111-2" for the area outside the floodway and "OS" for the established floodway which is to be dedicated to the City. PLANNING COMMISSION ACTION: (July 11, 1989) Staff informed the Commission that the item needed to be deferred because of the notice deficiency. A motion was made to defer the issue to the August 8, 1989 meeting. The motion was approved by a vote of 6 ayes, 0 nays and 5 absent.
