COVENANT BETWEEN PECAN LAKE PROPERTY
OWNER'S ASSOCIATION AND TALL TIMBER
DEVELOPMENT CORPORATION
BE 1T KNOWN BY THESIS PRESENTS:
That in consideration of the mutual benefits to all
parties, the undersigned covenant and agree as follows:
5':HLREAS, the Pecan Lake Property Owner's Association
represent the owners of residential. property owners in the
vicinity of the property being re -zoned under Zoning Case
No. Z-2934-E;
iVHEREAS, Tall Timber Development Corporation is the
owner of all tracts included in Zoning Case No. Z-2934-L;
WHL•'REAS, the prosier zoning for the tracts included in
case No. Z-2934-E has had a long and arduous history; and
the ordarly development of the Tall Timber Dairy property is
in the beet interest of all land owners in the area;
IT IS AGREED that the Pecan Lake Property Uwner's
Association and its members will waive all objections to
the rezoning of Tracts 1, 2, 4, and 8 for L-1 Quiet Business,
Tract 7 as F-Commercial and 'tract 9 as KF-18; and, that• Tall
Timber Development Corporation, owner, covenants and agrees
as follows:
1. That owner will file a Bill of Assurance for. 'tract
1 which shall provide, and owner does agree to include therein
a covenant that runs with the land for as long as Pecan Lake
Property Owner's Association, or its successor, operates the
recreational area as a recreational area for supportive 'prop-
arty owners in the area formerly called Tall Timber Dairy,
that the developer of Tract 1, shall, before building erection,
erect a wood or wire privacy fence, at least- six (6) feet in
height, that substantially obscures the recreational area
from car lights, or tae like, along the Last line of Tract
1, to a point that is 50 feet from the normal water level at
the outflow of Pecan Lake (Elevation 305 :•act above MSL is
believed to be said level).
2. That the Bill of Assurance for Tract 2 shall
contain, and the Owner agrees that it will include
therein a covenant that runs with the land, to leave
timber now on the following described green strip, and
will exercise diligence to prohibit: the draining of any
Polluted, or additional, water from Tracts 1 and 2 into
Pecan Take. The owner covenants that the green strip of
grass and timber shall be a SO foot contour from the
normal water level following the bank of Pecan Lake in
Tracts 1 and 2, said normal water level believed to be
at 305 feet above MSL. That no trees in excess of 3"
in diameter shall be cut from the said 50 foot strip at
any time, for so long as Pecan Lake is used by Pecan
Lake Property Owners Association, and by the residential
owners of the lands owned or formerly known as Tall Timber
Dairy.
3. It is agreed that E-1 zoning on Tract 5 may be

fore designated.

caused said tract of land to be surveyed by Robert 0. Rollaway,
Registered Professional Engineer, and a plat thereof made which
is identified by the title Tract 2-A being a Re -Plat of Tract x,
Paean. Lake Addition, Little Rock, Arkansas and the date ,.I Iii�
and by the atgnature of the said engineer and the said grantur(s)
and bears a Certificate of Approval executed by the Little Rook
Planning Commission, and is on record in the office of the
circuit Clark and ex-officio Recorder of Pulaski County, Arkansas,
in plat Book ^Sy page • b47..and the„grantor(e) do ha;eby make
this sill of Assurance.
The grantors) do hereby certify that they have platted
said real estate in accordance with said plat. The lands
embraced in said plat shall be forever known as designed on said
platy and every deed of conveyance for said property shall use
this designation.
The filing of this Bill of Assurance and plat for record
in the Office of the Circuit Clark and ex-officio Recorder of
Pulaski County shall be a valid and complete delivery and ded-
ication of the streets and easements shown on the said plat.
All buildings constructed on said lots shall be constructed
no nearer to the street than the building lino shown on the plat,
and all buildings shall be constructed in conformance with the -
Building Code and Zoning Ordinance of the City of Little Rook,
Arkansas,
This Bill of Assurance and the named plat may be amended
with the approval of a majority of the owners.
