HomeMy WebLinkAboutZ-5185 Staff AnalysisMay 30, 1989 Item No. 6 - Z-5185 Owner: Odus Pack Applicant: Same Location: 1-30 (east of McDaniel Drive) Request: Rezone from "R-2" to "C-4" Purpose: Carpet and building material sales Size: 4.58 acres Existing Use: Vacant SURROUNDING LAND USE AND ZONING: North - Vacant, zoned "R-2" South - Vacant, zoned "C-4" East - Vacant, zoned "R-2" West - Single family, zoned "R-2" STAFF ANALYSIS: The issue before the Commission is rezone 4.5 acres on 1-30 from "R-2" to "C=4." The proposal is to develop the site under consideration and the existing "C-4" property -to the south for carpet and building material sales. The land is currently vacant, as is the "C-4" along the southern boundary. On the three remaining sides, the property abuts "R-2" zoning. Other zoning found in the area includes "MF -18," "C-3" and "1-2." The land use is a mix of residential and nonresidential. This pattern is typical of the 1-30 corridor with commercial and industrial uses found along the interstate frontage and the residential areas, both single family and multi -family, to the north. The acreage in question abuts a stable single family subdivision on the west and vacant land on the other three sides. May 30, 1989 Item No. 6 - Z-5185 (Continued) Over the years, the City has endorsed a mix of "C-3," "C-4" and "1-2" reclassifications along 1-30. This request is consistent with the established pattern and Staff endorses the basic proposal. The depth of the nonresidential zoning varies along the corridor so the current rezoning appears to be compatible with the existing "C-4" lying to the east. Staff supports the "C-4" reclassification, but recommends that additional protection be provided for the existing subdivision to the west by rezoning a 50 foot strip to "OS," Open Space. One final plan element is the Master Parks Plan which identifies the creek on the east side as Priority II Open Space. ENGINEERING COMMENTS: Approximately the eastern one-third of the site is in the floodway and all the property is part of the floodplain found in the area. STAFF RECOMMENDATION: Approval of "C-4" with a 50 foot "OS" area along the west property line and "OS" for the floodway which is to be dedicated to the City. PLANNING COMMISSION ACTION: The application was represe �d by Norman Clifton. There were five objectors in att dance. Mr. Clifton disco ed the site and said that more thir�� as in the floodway. He asked that the 50 foot buffer on the west side, as recommended by the Staff, be reduced to 25 feet and an easement be utilized for the floodway instead of having to dedicate it. Mr. Clifton pointed out that the "C-4" to the south was rezoned without a buffer area, and made some other comments. He said that some trees have been cleared from the site and there was no use on the existing "C-4." Mr. Clifton said there were problems with the floodway dedication because it was more than one-third of the property. Basil Shoptaw of Thomas Engineering- ___-said there were possible o p i o �� �F;- l -o o d-aa�-� �rer-moo v i n g t h e c r e e k. Mr. Shoptaw said the floodway was 300 feet wide and the dedication requirement would have an impact. He also suggested that screening, or a wall, be utilized along the western edge instead of the 50 foot "OS" area. May 30, 1989 Item No. 6 - Z-5185 (Continued) Jerry Gardner, City Engineering Office, said the floodway was based on the hundred year flow rate and the existing topography. Mr. Gardner also discussed some options, including containing the entire floodway within the creek channel. Jimmy Patton objected to the "C-4" rezoning and said the existing "C-4" parcel was a problem. Mr. Patton voiced concerns with flooding and potential traffic problems. He also said that some trees have been removed from the site. Mike Wood concurred with Mr. Patton's comments and discussed the traffic problem in more detail. He also said that moving the creek to the east would not help. Billye Williams discussed problems with a ditch and flooding. She questioned whether a commercial use would impact the sewer and suggested that more water would be pushed into the neighborhood because of the rezoning and development. Norman Clifton made some comments and agreed to amending the request to the Staff's recommendation of "C-4" with a 50 foot "OS" area on the west side and "OS" for the established floodway. There was some discussion about drainage and removal of the trees. A motion was made to recommend approval of the request as amended to "C-4" and "OS." The motion passed by a vote of 6 ayes, 1 nay, 2 absent and 2 abstentions (Martha Miller and John McDaniel).
