A variance is requested from the
area regulations of Section 36-302
to permit construction of an
addition with a reduced side yard
setback.

1. West 65`h is listed on the Master Street Plan as a minor
arterial. A dedication of right-of-way to 45 feet from
centerline is required (12.5 ft. dedication). Franchise
required for parking in area of new dedicated right-of-
way.
2. Property frontage needs to have the sidewalks and ramps
brought up to the current City and ADA standards.
3. Repair or replace any curb and gutter or sidewalks that
are damaged in the public right-of-way prior to
occupancy.
4. Stormwater detention ordinance applies to this property
with planned development.
5. Master Street Plan requires 59 feet pavement for five
lanes. Provide in -lieu of % lane construction at time of
building permit.

B. Staff Analysis:
The C-4 zoned property located at 4910 West 65`h Street is
occupied by a 3,600 square feet, one-story, frame and metal
building which houses Lloyd's Carpet World, a retail floor
covering sales business. Lloyd's proposes to double the
size of the building by adding a 60' X 60' addition to the
rear of the building. The addition will provide additional
storage and work area. The proposed addition will maintain
the existing 9.4 foot side yard setback on the west side.
The code requires a 15 foot side yard setback in the C-4
district.
Staff believes the variance request to be reasonable. The
existing building has a 9.4 foot side yard setback.
Allowing the new addition to maintain that same setback
should have no effect on the adjacent property. The C-3
zoned property adjacent to the west is occupied by an auto
repair business. A driveway/parking area on this adjacent
property provides adequate separation between the two
buildings. The addition will have a rear yard setback of
160+ feet and a side yard setback on the east of 85± feet.
The site plan submitted by the applicant does not propose
any new parking area. It may be necessary to provide
additional parking to accommodate the expansion. There is
more than adequate room available to add on to the existing
parking lot, if necessary.
C. Staff Recommendation•
Staff recommends approval of the requested side yard setback
variance subject to compliance with the following
conditions:
1. Compliance with the City's Landscape and Buffer
Ordinances
2. Compliance with the parking requirement established by
city code
3. Compliance with Public Works Comments

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval,
subject to compliance with the conditions noted above.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 3 ayes, 0 noes, 1 absent and
1 open position.
