North - Multifamily, zoned "R-5"

STAFF ANALYSIS:
The request is to rezone one acre on West 65th Street from
"C-3" to "C-4." Currently, there is a commercial building
on the site and the proposal is to convert the structure to
an auto paint and body shop which is not permitted in the
"C-3" District. The building is situated on the southern
part of the site along with a paved area. The balance of
the property is undeveloped.
The zoning pattern found in the area is a mix of "R-2,"
"R-5," 110-3," "C-3," "C-4" and "1-2" with the property
abutting "R-2," "R-5" and "C-3." Across West 65th Street,
the existing zoning is "C-3," "C-4" and "1-2." The land use
is very similar to zoning and includes residential,
commercial, a church, office and industrial. On the east
side of the tract, there is a church; and to the west, there
is an auto oriented use - a tire installation business.
Directly to the east of the church, there is a major
industrial area with a wide range of industrial type
facilities and other nonresidential uses. The multifamily
units, the nearest residential use, are located to the north
and south.

Staff's position is that the proposed "C-4" reclassification
is compatible with the area and supports the request.
Because of the different zoning classifications, there is no
established zoning pattern along the West 65th Street
frontage and the "C-4" rezoning will not impact the
surrounding properties or establish any undesirable
precedent. The existing residentially zoned land or uses
will not be affected by the zoning change so there reason to
require any buffering beyond what is provided for in the
Zoning Ordinance for the "C-4" District.
ENGINEERING COMMENTS:
West 65th Street is classified as a minor arterial which
requires a total right-of-way of 90 feet, or 45 feet from
the center line. It appears that additional dedication will
be required because the existing right-of-way is deficient.
STAFF RECOMMENDATION:
Staff recommends approval of the "C-4" rezoning as
requested.
PLANNING COMMISSION ACTION: (April 18, 1989)
The applicant was present. There were no objectors in
attendance and the item was placed on the consent agenda. A
motion was made to recommend approval of the "C-4" rezoning.
The motion was approved by a vote of 8 ayes, 0 nays and
3 absent.
