Johnson Lawrence Holt, Jr. 1417 South Chester Street Rezone from "C-3" to "R-4" Single family 0.17 acres Single family SURROUNDING LAND USE AND ZONING: North - Single family, zoned "C-3" South - Single family, zoned "C-3" East - Single family, zoned "0-3" West - Duplex, zoned "R-4" STAFF ANALYSIS: The lot in question is zoned "C-3" with a single family residence on it, a nonconforming use. The owner attempted to secure a building permit for a two -car garage but the permit was denied because of the property's nonconforming status. The Zoning Ordinance prohibits expansion of nonconforming uses, and that is why this issue is before the Commission. After filing the necessary rezoning application, the owner was able to obtain a building permit for the addition and the new construction has been initiated. The existing nonresidential zoning of the lot and a high percentage of the immediate vicinity was accomplished through the Urban Renewal Program of the late 1960's. A number of properties along both West 14th and Chester Streets were rezoned to a commercial classification through the effort, and there is even some industrial zoning north of West 14th Street. Other zoning in the neighborhood includes "R-4" and "0-3." Very few of the commercial lots have been developed for nonresidential uses and the character of the neighborhood south of West 14th is primarily residential with a mix of single family and multifamily units. It appears that for the foreseeable future, the existing land use pattern will not change and April 18, 1989 Item No. 3 - Z-5167 (Continued) rezoning the lot to "R-4" is the appropriate action to take at this time. (Several years ago, the lot directly across Chester Street was rezoned to "R-4" to allow conversion of a structure to a duplex.) ENGINEERING COMMENTS: Chester Street is classified as a minor arterial which requires a total right-of-way of 90 feet, or 45 feet from the center line. STAFF RECOMMENDATION: Staff recommends approval of the "R-4" rezoning and waiver of the filing fee. PLANNING COMMISSION ACTION: (April 18, 1989) The applicant was present. There were no objectors and the item was placed on the consent agenda. A motion was made to recommend approval of "R-4" as requested. The motion passed by a vote of 8 ayes, 0 nays and 3 absent. The Planning Commission also waived the filing fee and the notification of property owners by certified mail.
