HomeMy WebLinkAboutZ-5131 Staff analysisFebruary 21, 1989 SUBDIVISIONS Item No. 9 Name: Location: Owner/Applicant: Proposal: Lord of Life Lutheran Church Conditional Use Permit (Z-5131) The west side of Kerby Road 430 feet south of Sweet Bay Drive. Lord of Life Lutheran Church/ Pastor John Trinklein To construct a church and related facilities in three phases. The phases are: I - Fellowship Hall (150 capacity), pastor's office, daycare (70 capacity), and classrooms (9,500 square feet in total); II - 7,880 square feet administration and classroom building; and III - A 16,350 square feet auditorium (1000 capacity, 70 feet to the top of the spire) and a total of 338 parking spaces. The project will be constructed on ten acres of land zoned "R-2 . " Ordinance Design Standards: 1. Site Location Adjacent to a collector street (Kerby Road). 2. Compatibility with Neighborhood This site is abutted by vacant land to the south and west, a church and single family (rear yard relationship) to the north, and single family (front yard relationship) to the east. The proposed church site is heavily wooded (ten acres) and should be compatible with the surrounding area. February 21, 1989 SUBDIVISIONS tem No. 9 3. On-site Drives and Parking The applicant is proposing to construct a total of 338 paved parking spaces (Phase I - 53 parking spaces; Phase II - 96 parking spaces; and Phase III - 188 parking spaces) and two access drives to Kerby Road. 4. Screening and Buffers The site plan contains a 15 foot landscaped buffer on the north and east property lines as well as leaving some wooded areas intact. The applicant has also agreed to comply with the City's Landscape Ordinance. 5. Analysis The Staff feels that the proposed use will be compatible with the surrounding area. The Staff also feels that the applicant's proposal to dedicate the entire necessary right-of-way on Kerby Road to meet collector street standards and to construct their one- half of the improvements to a point south of the southernmost drive during Phase I of the construction is acceptable. The applicant should finish the balance of the said collector street improvements during Phase III construction. In addition, the applicant needs to revise the site plan to show the sidewalk within the public right-of-way and state the number of stories and maximum height of each proposed building. Finally, the applicant needs to meet with the City Traffic Engineer to provide a profile of the driveway locations so as to determine the best site distances and also to discuss the parking lot relationships to their respective driveways. 6. City Engineering Comments (1) Dedicate and construct Kerby Road to collector street standards (one-half 60 feet right-of-way, 36 feet pavement width); (2) Show land lines and existing dedication on Kerby Road; and (3) Comply with Stormwater, Detention and Excavation Ordinance requirements. Staff Recommendation Approval, provided the applicant agrees to: (1) Provide street improvements as outlined in the Analysis Section; (2) Meet with the City Traffic Engineer for possible redesign of parking spaces and drive locations; (3) Comply with City Engineering requirements numbered 1-3; and (4) Provide a revised site plan that includes the information as outlined in the Analysis Section. SUBDIVISION COMMITTEE REVIEW The applicant was present and stated that the sanctuary's height would be 30 feet (building) and that the remainder of the proposed structures would be one-story in height. The applicant agreed to comply with Staff's recommendations. PLANNING COMMISSION ACTION: The applicant was present. There were no objectors. The Commission voted 8 ayes, 0 noes and 3 absent to approve the application as per the revised site plan and as recommended by the Staff, reviewed by the Subdivision Committee and agreed to by the applicant.
