Davis by Matt Ulmer Asher Avenue and Western Hills Ave. Rezone from "R-2" to 111-2" Industrial 0.77 acres Vacant SURROUNDING LAND USE AND ZONING: North - Daycare, zoned "C-3" South - Vacant, zoned "R-2" East - Vacant, zoned "R-2" and "C-3" West - Industrial, zoned "1-2" STAFF ANALYSIS: This request was filed after the owner attempted to secure a building permit which was denied because of the "R-2" zoning. The proposal is to make an addition to an existing building that fronts on Western Hills Avenue and add some parking spaces. A portion of the proposed construction along with some of the new parking area encroaches into the existing "R-2" area and before the building permit can be issued, an 111-2" rezoning must be granted. The addition is approximately 60' x 120' and, based on the site plan, it appears that about 30 feet of it is in the "R-2" area. Zoning is mixed in the vicinity and includes "R-2," "R-3," "MF -12," "0-21" "C-3," "C-4" and "1-2" with the property in question abutting "R-2." "C-3" and 111-2." Land use is made up of residential, commercial, industrial and a daycare center. There are two public facilities nearby, an elementary school and a post office branch on Asher Avenue. Some of the land is still vacant, and to the south on Western Hills there is a golf course. Expanding the industrial zoning at this location should not effect any of the surrounding properties and Staff supports the "1-2" reclassification. Along the southern property line there is a heavily wooded area that will remain so the "R-2" land will be buffered and the rezoning should not have any impact on it. January 24, 1989 Item No. 2 -- Z-5123 (Continued) ENGINEERING COMMENTS: There are no engineering issues. STAFF RECOMMENDATION: Staff recommends approval of the 111-2" rezoning. PLANNING COMMISSION ACTION: (January 24, 1989) The applicant was present. There were no objectors. A motion was made to recommend approval of the 111-2" request as filed. The motion passed by a vote of 11 ayes, 0 noes and 0 absent.
