Kohler 500 East Eighth Street Little Rock, Arkansas 72202 RE: Conditional Use Permit for Catering Operation at 511 East Eighth Street, Little Rock, AR 72202 Dear Mr. Kohler, I would like to thank you for taking the time to speak with me and would lake to specifically address your concerns as you expressed them to me and to Ms. Anna Brown, with The City of Little Rock's Department of Planning. We offered to the City, and the City stipulated as a condition, that we ( myself and one other employee) park in the parking spaces provided on the property in the rear of the building, The other tennants in the building have agreed to make sure spaces are available fir us during the ]business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. The space in question usually rents to couples who have also required parking for two automobiles. Mr. Kohler, I also have to meet regL&ements of the Health Department and will hire an additional waste disposal service should I find that the current waste dispcsal services are inadequate for our needs. My interests in using tl-is location are for proximity and convenience to my clients, opportunity to establish a service that is desired by and compatible with a number of the services already operating in the 4 uapa w Quarter, and convenience in managing my brother's. I certainly do not wish to di=pt the ambiance of the neighborhood, as I foo have lived and/or worked in the area for over five years. As a home owner, I am sure you invest more of your time taking care of your property than a renter would invest in taking care of rented property. If we are able to use this location, I will be on site daily to both manage the property and my business. As it is my brother's property, I would certainly have more interest and regard for the property than if it was leased to a renter. And as you mentioned to me in our first conversation, my brother has invested his time and resources in several improvements to his property. I hope you will consider our possible contributions as a neighbor. Currently within three blocks, a grocery store, a liquor store, a photography studio, attorney's offices, an answering service, day care services, a consulting firm, and other busi ne-- ses are providing services to the residents and businesses in the Quapaw Quarter. All of these business generate additional traffic. We will be delivering all of our products to our clients and, therefore, do not foresee generating any additional traffic. We are only two women, with two autos, who have an opportunity right now to work hard to realize a dream. My understanding is that this change in the permit would allow a "catering operation" to do business out of one of the apartments. To my knowledge, there are only three (3) owner occupied properties within two hundred (200) feet of 511 East Eighth Street. These three (3) property owners are myself and my wife, Dr. Patricia A. Kohler, Johns Cooper and Jann Greenland. We are the sole owners of the Sheppard Place Horizontal Property Regime, 500 East Eighth Street. None of us were notified that a change in the usage permit was to be considered. On this point, I request that we be allowed to voice our objections at the regular meeting of the Planning Commission in November. I understand that the agenda meeting is to be held on 11/19/88. Please address my request at this meeting, so that I may be allocated time on the agenda for the regular meeting. My specific objections to this type of business locating in this quiet residential neighborhood are the issues of A) Parking, or rather lack of it; B) Precedent for future decisions regarding this area of the MacArthur Park Historic District; C) Waste disposal created by a food service operation. We appeal to you to allow us to address each of these issues at the meeting of the Planning Commission, if you will be so kind as to advise us of the specific date and time. Z-5101 located at 511 East 8th Street in order to operate a catering service. Staff informed the Board of the circumstance involved in the deficient notice requirement. A motion was made and passed to grant a rehearing per the request of Mr. Kohler (see enclosed copy of letter. A courtesy letter of notice has also been sent to Mr. Johns Cooper, Ms. Jan Greenland, and Mr. Kinnard Kohler informing them of the rehearing date. The rehearing will take place on December 19, 1988 at 2:00 p.m. on the second floor of Little Rock City Hall, Board of Directors Chambers, Markham at Broadway Streets. It is incumbent upon you to be in attendance for the purpose of addressing the concerns of Mr. Kohler and any other persons present. As stated to you when the notices for case no. Z-5101 were given to me and in the telephone conversations which have occurred, any approval by the Little Rock Board of Adjustment is placed on hold until all or any complaints are resolved. By placing the approval of the Board of Adjustment on hold it is advised that no further work or expense be incurred until a decision is acted upon by the Board of Adjustment. I do understand that by having to place your pending business on hold present■ past and possibly future expenses may be lost, but unfortunately that possibility was expressed to you by me when I explained the reasons behind the requirement of the notice to property owners needing to be done by obtaining a certified abstract list of those property owners within the 200 feet requirement.
