AN ORDINANCE RECLASSIFYING VARIOUS PROPERTIES
LOCATED IN THE THREE MILE EXTRATERRITORIAL
ZONING JURISDICTION OF THE CITY OF LITTLE ROCK,
ARKANSAS, AMENDING SECTION 36 OF THE CODE OF
ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS;
AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zone classification of the
following property be and is hereby changed'as indicated:
Z-5099 - Described as part of the NW 1/4 of Section 15,
T -2-N, R -14-W, Pulaski County, Arkansas more
particularly described as:
Starting at the intersection of the north right-of-way
line of Arkansas State Highway No. 10 and the east line
of the SE 1/4, NW 1/4, said Section 15; thence westerly
along said north right-of-way line of Arkansas State
Highway No. 10 the following bearings and distances:
North 80058' west 91.9 feet; north 80044' west
892.8 feet; north 09°16' east, 5.0 feet north 80044'
west, 398.15 feet; and north 82'009120" west,
139.40 feet to a point; thence north 00026140" west,
540.0 feet to a point; thence north 32050114" east,
290.0 feet to a point; thence south 57032156" east,
14.40 feet to the Point of Beginning; thence north
32050114" east, 510.75 feet to a point; thence south
49054150" east, 954.95 feet to a point; thence
southwesterly along the arc of a 409.26 foot radius

SECTION 2. That a 40 -foot landscaped strip parallel to
and abutting Arkansas State Highway 10 shall be provided and
maintained by the owner.
SECTION 3. That the map referred to in Section 36 of
the Code of Ordinances of the City of Little Rock and
designated district map be and is hereby amended to the
extent and in the respects necessary to affect and designate
the change provided for in Section 1 hereof.
SECTION 4. That the ordinance shall take effect and be
in full force from and after its passage and approval.

On December 13, 1988, the Planning Commission approved C-2
for the 16.4 acres site, C-3 for the 4.7 acres tract with
40 feet landscaped area along Highway 10, 0-3 and OS for
right-of-way reservation and dedication area along Highway
10.
Dedication of additional right-of-way for Highway 10 is
required and the right-of-way needs to be dedicated to
the State Highway Department.
Return completed easement deed to the Planning office by
January 12, 1989.

Dear Mr. Pfeifer:
Pursuant to your request, I am writing to provide the City's
response to your letter of December 8, 1588 concerning the
interchange at Highway 10 and the extension of Chenal
Parkway north of Highway 10.
We agree with all of the provisions in your letter, except
that items (1), (4), and (5) are subject to approval by the
Arkansas State Highway and Transportation Department. We
will support your requests to the Highway Department for
access and turning movements as outlined under items
(1)(A), (1)(B), (4), and (5). However, we have decided not
to support the partial construction described in item
-(1)(C). If for some reason (1)(C) is constructed, any
temporary turn lane would have to be constructed at
developer's expense. Furthermore, it is our understanding
that you do not have any objection to the right-of-way
reservation area being zoned "OS" together with the 55,f t.
of normal right-of-way dedication on Highway 10.

Dear Gary and Jerry:
We met today to deal with my letter of 12/1 and the following is my
understanding of the results of our meeting; paragraph numbers refer to
my 12/1 letter:
(1) Highway 10 is presently to be widened by the Arkansas Highway Depart-
ment. There seem to be three possible cross sections they might
construct:
(A) 4 lane
(B) 5 lane (with center left -turn or "suicide" lane).
(C) 4 lane divided (this plan would partially construct the Garver
& Garver 20?? plan as to divided 4 lane for Highway 10 west of
the intersection. This plan would otherwise restrict both
Deltic and my property to "right in - right out only" where the
lanes are divided. You have assured me you would support left
turn lanes through the median temporarily until that area was
needed for construction of the overpass).
Under any of these circumstances, the City would make no restric-
tions on curb cut access to and from my property other than in
current ordinances: none for 100' either side of intersection and
then, one every 300'.
f2) Yes. The reservation boundary will taper off, paralleling the
merging lane.
(3) No. The reservation area will not allow parking, but the
reservation will be intended for future purchase:. I will not be
required to donate it.

(4) Yes.
(5) A new street would not be permitted. An all four -movement access
would be allowed EAST of the western boundary of the C-2 zone, under
any of the 3 cross sections (A), (Ei), or (C) above.
(6) In addition, in the course of our meeting, you indicated you would
support the 2.86 acre additional 0-2 zone on Highway 10, not
previously the subject of an application, when I apply for it.
I would like to have some documentation from the City that this
constitutes our understanding. Upon receipt thereof, you may consider
that I have withdrawn any objections I had to the Deltic land use plan
and zoning, which I had only registered because of its impact on the
intersection design.

You have each asked me to respond to the latest Garver & Garver design of
the Highway 10/Chenal Valley Parkway Intersection (The Intersection),
with grade separations to accomodate future traffic volumes. (You call
this the "2005 plan", I call it the "2030-2040 plan".)
I appreciate your efforts to minimize the impact on my property by alter-
ing the original submittal and I am willing to accept this design with
the following provisions:
(1) I want to see and accept the design for The Intersection as you will
require it to be built now, including turning movements into and out
of my property.
(2) The 40' reservation area will terminate after the lanes merge.
(3) The 40' reservation area will be zoned to allow parking; only build-
ings will be prohibited. The land will be reserved for purchase by
a governmental entity or a Special Improvement District, but I will
not be required to donate it.
(4) All four left turn movements will be permitted at The Intersection
under the present and future plans.
(5) All turning movements will be permitted at a new street intersection
with Highway 10 approximately 1600' west of "The Intersection".
(6) Approval of the slight zoning changes shown on the attached plat
which were necessitated by the proposed intersection design.
