HomeMy WebLinkAboutZ-5096-C Application1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 ORDINANCE NO. 19,825 AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, TO PROVIDE FOR A DEFERRAL OF MASTER STREET PLAN CONSTRUCTION REQUIREMENTS FOR KANIS ROAD; AND FOR OTHER PURPOSES, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That Chapter 30 of the Code of Ordinances be amended to provide for a deferral of certain requirements within the Master Street Plan until the adjacent property along Kanis Road is developed by Rocket Properties, Inc, as part of the Woodlands Edge Conceptual Long -form PCD located southeast of the intersection of Kanis Road, Kirby Road, and Cooper Orbit Road. Subsection a. Chapter 30 Article VI requiring developers to construct roadway improvements to the requirements of the Master Street Plan will be deferred for a period of five (5) years, until the lots that front Kanis Road develop, or until adjacent development along Kanis Road occurs whichever occurs first. The specific deferral is for improving Kanis Road to minor arterial standards including widening to 29.5 ft from centerline, curb, gutter, drainage improvements, sidewalk, access ramps, street lights, and construction of a right turn lane. Subsection b. On Kanis Road, at least 45 foot right of way from centerline or of sufficient width for installation of the intersection improvements and right turn lane will be dedicated along Kanis Road with the final plat. Section 2. Severability. In the event any title, section, paragraph, item, sentence, phrase or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of such inconsistency. WHEREAS, Ordinance No. 16,908 was adopted on June 20, 1995, establishing a planned zoning district; and WHEREAS, a portion of the PRD use never developed; and WHEREAS, the Little Rock Planning Commission has determined the PRD should be revoked for a portion of the undeveloped PRD per Section 36-458(a) and the zoning classification as previously existed restored. Information Report Submitted by: Department of Planning and Development Bruce Moore SYNOPSIS The applicant requests that the existing PD -R zoning be revoked and the property revert to the originally zoned R-2, Single-family Zoning District. FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the requested revocation. The Planning Commission voted to recommend approval of the revocation request at their March 1, 2007, Public Hearing by a vote of 10 ayes, 0 noes and 1 absent. CITIZEN Notices of the public hearing were mailed to all residents PARTICIPATION located within 300 -feet of the site along, the Parkway Place Property Owners Association, the Gibralter Height/Point West/Timber Ridge Neighborhood Association and the Spring Valley Manor Property Owners Association. BACKGROUND Ordinance No. 16,908 adopted by the Little Rock Board of Directors on June 20, 1995, established the Brodie Creek Conceptual PRD rezoning 700+ acres from R-2, Single- family to PRD. The conceptual plan included a BACKGROUND CONTINUED comprehensive plan establishing areas for residential, commercial and recreational uses. Ordinance No. 16,910 adopted by the Little Rock Board of Directors on July 3, 2001, added an additional 75 acres to the approved site plan. Only a portion of the approved development plan was constructed, near Bowman Road. Since that time two revocation actions have occurred on portions of the approved PRD zoned area. Ordinance No. 18,518 revoked the previously identified Phase 4 PRD zoning restoring the R-2 Single-family zoning classification and Ordinance No. 19,012 revoked the PRD zoning classification for the southern portion of the PRD zoned area (Near Saw Grass Drive). Presently there are two areas remaining zoned PRD. The first is an area located near Kanis Road containing approximately 48 acres and the second located near the Olds Road area containing 300 acres. Per Section 36-458(a) Cause for revocation as enforcement action. The Planning Commission may recommend to the Board of Directors that any PUD or PD approval be revoked and all building permits or certificates of occupancy be voided under the following circumstances: (1) The applicant has not submitted a final development plan to staff. Where a staged development plan is approved the Board of Directors may revoke the entire preliminary plan or may revoke only that stage on which a final plan has not been submitted and approved. (2) Construction has not commenced within the time allowed. (3) The applicant has not adhered to the development schedule as stated in the approved preliminary plan. In addition, to the revocation for cause, Section 36-454(e) final development plan states the applicant shall have three years from the date of passage of the ordinance approving the preliminary approval to submit the final development plan. Request for extensions of time shall be submitted in writing to the Planning Commission which may grant one extension of not more than two years. Failure of the applicant to file a timely extension shall be cause for revocation of the PUD as provided in the ordinance. Of the remaining 300 acres zoned PRD, 87 acres are proposed for single-family development and 14 acres are proposed for development with an office and commercial mixed use development. The total of 100 + acres are proposed for revocation. 0 BACKGROUND CONTINUED Per the ordinance requirement of the procedure for revocation, staff has contacted the applicant indicating the default of approval and setting a time to appear before the Planning Commission to show cause why steps should not be made to totally or partially revoke the POD zoning classification. According to the ordinance, the Planning Commission shall provide a recommendation which shall be forwarded to the Board of Directors for disposition as in the original approval. The applicant is agreeable to the revocation. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Sections 1 and 2 hereof. SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. SECTION 6. It is hereby determined by the Board of Directors of the City of Little Rock that there is immediate need to revoke the PRD zoning classification for a portion of the Brodie Creek Long -form PRD Revocation, located South of Kanis Road and East of Kirby Road (Z -5096-C). An emergency is therefore declared to exist and this ordinance shall be in full force 'and take effect from and after its passage and approval.
