That at the voluntary request of the applicant during the May 16,2023,meeting of the Little 2 Rock Board of Directors,the following conditions shall also apply to this Planned Office Development: 3 (a) Building height shall not exceed forty(40)feet in total;and, 4 (b) Dumpsters shall be located at the northeast corner of the parking lot, and pick-up hours for 5 trash collection shall be limited to between 6:00 AM and 7:00 PM, as set forth in the property 6 description in Section 1 above; and, 7 (c) Business hours for the building, including hours for delivery, shall be limited to 7:00 AM to 8 8:30 PM daily; and, 9 (d) Accessory use of an eating establishment without drive-in service shall be located at the 10 southeast corner as set forth in the property description in Section 1 above of the development 11 with the following additional conditions: 12 i. Outdoor seating, if any,shall be limited to the east side of the building;and, 13 ii. Operating hours for Sunday through Thursday shall be limited to 10:00 AM to 9:00 14 PM;and, 15 iii. Operating hours for Friday and Saturday shall be limited to 10:00 AM to 10:00 PM. 16 (e) Landscaping of Emerald Green Arborvitae Trees are to be planted at a distance of eight(8)feet 17 apart on the center of the west side of the opaque eight(8)-foot fence in order to provide a more 18 aesthetic view for the adjacent neighborhood, as well as provide easier maintenance for the 19 development;and, 20 (f) Business uses for this POD shall not include the following: 21 i. Bank or Savings and Loan Office; 22 ii. College Dormitory; 23 iii. College Fraternity or Sorority; 24 iv. Convent or Monastery; 25 v. Day Nursery or Day Care Center; 26 vi. Day Care Center, Adult; 27 vii. Fire Station; 28 viii.Government or Private Recreational Uses, including, but not limited to, golf courses, 29 tennis courts,swimming pools,playgrounds,day camps,and passive recreational open 30 space; 31 ix. Lodge or Fraternal Organization; 32 x. Mobile Canteen Units, even when operated in compliance with current Planning 33 Department regulations for such vehicles; 34 xi. Mortuary or Funeral Home; 35 xii. Nursing Home or Convalescent Home; I Page 2 of 41 1 xiii. Medical Marijuana Cultivation Facility as an accessory use; 2 xiv. Cemetery or Mausoleum as a conditional use; 7 xix. Establishment for care of Alcoholic, Narcotic or Psychiatric Patients as a conditional 8 use; 9 xx. Microbrewery or Microbrewery Restaurant as a conditional use; I 0 xxi. Multifamily dwellings(as per an R-5, Urban Residence District)as a conditional use; 11 xxii.Orphanage as a conditional use; 12 xxiii. Parking, Commercial Lot or Garage as a conditional use; 13 xxiv.Taxi Office as a conditional use. 14 Section 3. That the preliminary site development plan/plat be approved as presented to the Little Rock 15 Planning Commission. 16 Section 4. That the change in zoning classification contemplated for Hamilton Station POD, located 17 north of 14800 Cantrell Road(Z-7500-I), is conditioned upon obtaining final plan approval within the time 18 specified by Chapter 36,Article VII, Section 36-454(e)of the Code of Ordinances. 19 Section 5. That this ordinance shall not take effect and be in full force until the final plan approval. 20 Section 6. That the mapreferred to in Chapter 36 of the Code of Ordinances of the Cityof Little Rock, p 21 Arkansas,and Designated District Map be and is hereby amended to the extent and in the respects necessary 22 to affect and designate the change provided for in Section 1 hereof. 23 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 24 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 25 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 26 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 27 ordinance. 28 Section 8. Repealer.
