The action taken was in regard to the ruling by the Board of Adjustment on May 22, 1989 regarding an earlier condition placed on a variance of approval for a carport which had been violated. The condition stated that the carport could never be enclosed. The Board of Adjustment, by a vote of 8 ayes, 0 nays, 1 absent, instructed the Office of Comprehensive Planning and the Environmental Codes Office to take any and all necessary steps toward processing enforcement action against the owners of the property located at 5125 Stonewall Road. It was the opinion of the Board members present that it was incumbent upon the agent and/or owner to make some attempt toward correcting the earlier ruling and instructions given to the agent at the May 22, 1989 meeting. Since Staff had not received any communication from either parties, nor was either in attendance at the meeting, the actual motion also includes the fact that there exists no possible chance for a rehearing before the Board of Adjustment regarding the violation of the condition placed on the earlier approval for the carport. Please be advised that verbal communication has been made with the enforcement officer assigned to 5125 Stonewall Road.
