PROPOSAL:
To obtain a Rezoning and Conditional Use Permit which would
allow construction of a 1,728 square feet six or eight stall
barn to board horses and to continue to occupy an 1,264 +/-
square feet single family structure all located on
4.98 acres of land that is zoned "R-2."

ORDINANCE DESIGN _STANDARDS:
1. Site Location
Adjacent to an arterial street (Stagecoach Road).

The property is abutted by single family located to the
north and south, vacant land to the east, and
industrial (salvage yard) located to the west. The
site is almost five acres which would allow for ample
grazing area. The proposed use is compatible with the
surrounding area.
3. On. Site Drives and Parking
One driveway serves as access to Stagecoach Road.
4. Screening and Buffers,
The applicant is proposing to use the existing trees,
fences, and shrubbery.

5. Analysis
The Staff feels that the proposed use is compatible
with the surrounding area.
6. C,i.ty_.Engi.neer Comments
(1) Dedicate one-half 90 feet right-of-way on
Stagecoach Road to meet Master Street Plan
specifications; and
(2) Comply with the City's Boundary Street
Improvements Ordinance.
7. „Staff Recommendation
Approval provided the applicant agrees to comply with
City Engineer comments numbers 1 and 2.
SUBDIVISION COMMITTEE REVIEW: (August 11, 1988)
The Applicant was present and agreed to comply with Staff
recommendations. The Applicant also stated that they would
like to possibly fence in part of the front yard with a six
feet fence. The Staff and the Committee felt that the
Conditional Use Permit could be approved with the condition
of allowing a six feet in height fence.to be placed at the
front yard setback line (50 feet required in AF District).
The Applicant stated that the proposal would meet their
needs.
PLANNING COMMISSION ACTION: (August 23, 1988)
The Applicant was present as was one objector (Ray
Dennison). The Applicant stated that objected to the
requirement of street improvements. He stated that
dedicating a right-of-way should be enough. Mr. Ray
Dennison, a neighbor, objected to locating a commercial
stable so close to the property line (45' from the north
property line). The Applicant stated that he had to locate
it there due to the property being located in the
floodplain. Mr. Dennison stated that the barn had already

been constructed. The Staff stated that it was their
understanding that a person could keep their own horses on
lands zoned "R-2." Mr. Dennison continued to object to the
proposed commercial stables. Mr. Morriss withdrew his
proposal.
