Morriss, Jr. Same 10701 -Stagecoach Road Rezone from "R-2" to AF Single family and stables (boarding) 4.98 acres Single Family (with livestock) SURROUNDING LAND USE AND ZONING: North - Vacant and residential, Zoned "R-2" South - Vacant and residential, Zoned "R-2" East - Vacant, Zoned "R-2" West - Industrial, Zoned "R-2" STAFF. ANALYSIS: The issue before the Commission is to rezone approximately 5 acres on Stagecoach Road from 11R-2" to AF for a horse stable. In addition to the rezoning action, the Planning Commission must also approve a Conditional Use Permit (Item No. 6 - Z -5058-A) to allow a commercial boarding stable. The property has only a single family residence on it and the proposal is to construct a 36' by 48' barn if the rezoning and Conditional Use Permit are granted. A large portion of the site is in the floodplain but there is no floodway involvement. Zoning in the immediate vicinity is a mix of "R-2," "C-2," 11C-3" and 111-2" with -the property in question abutting "R-2" on all sides. Land use is made up of single family residential, office with a testing fab, and a junkyard which is directly across Stagecoach Road. Some of the land is still vacant including the 110-2" and "1-2" tracts. Another use found in the area is the raising of livestock on a minimal scale and the site under consideration had cattle on it at one time. Staff's position is that an AF reclassification for the proposed use is a reasonable option for the property and supports the request. One purpose of the AF district is to function as a transition area and it appears this is how the property will be utilized. The Otter Creek Plan recommends a mix of commercial arrd office land uses for the area and an AF rezoning should have little effect on the suggested development pattern. .ENG -1 NEER I.NG.. COMMENTS : 1. Dedication of additional right-of-way for Stagecoach Road - one-half of a 90' right-of—way or 45' from the center line. 2. The owner will have to conform to the Boundary Street Ordinance. STAFF_ RECOMMENDATION: Staff recommends approval of the AF rezoning as requested. PLANNING,COMM ISSION _ACTI.ON: (August 23, 1988) The applicant, Paul Morriss, Jr., was present. There was one objector in attendance. (Items No. 6 and 6A were discussed together.) Mr. Morriss spoke and said he did not object to the right-of-way dedication for Stagecoach Road but was concerned with the Boundary Street Ordinance requirements for his rezoning request. Ray Dennison opposed the request and said the barn was constructed. Mr. Dennison went on to describe the area and said there were problems with allowing horses next to residential uses. Mr. Morriss told the Commission the barn was in place, completed about a month ago, and has two stalls. He also indicated that the majority of the property was in the floodplain. After some additional discussion, Mr. Morriss withdrew the request from consideration. (No vote was taken by the Planning Commission.)
