We hereby request a rehearing of the above case in
order that we might have an opportunity to meet with
City engineers to satisfy any fears they might have
about building over the concrete box culvert and to
meet with City attorney to correct any problems with
the previously prepared document that indemnified the
City against any damages that might possibly occur,
I realize that we should have met with the City engineer
and attorney prior to the June 20 meeting, but the
owner of the property, based on a meeting with City
staff, indicated that there would not be any problem
with the requested variance.
Thus we hereby respectfully submit a request for a
rehearing of the above matter and look forward to your
favorable response.

AGREEMENT
THIS AGREEMENT is made this I zH day of June, 1988,
by and between Sherman Realty Co., Inc., Bruce Thalheimer,
Jr., Lee S. Thalheimer, Sam Strauss III,` &�� _
Strauss,
Susan Strauss d/b/a East Roosevelt Shopping Center and the
City of Little Rock.
WITNESSETH:
WHEREAS, East Roosevelt Shopping -Center has requested a
variance from the set back provisions of § 7-103.3 of the
Little Rock City Code of Ordinances whereby they will be
allowed to construct an expansion of an existing building
over an existing drainage easement.
WHEREAS, the City has no objection to the structure
being over the drainage easement provided they have access to
the easement and will not be legally responsible for damages
caused at such times as they have to access the easement.
IT IS, THEREBY AGREED that the East Roosevelt Shopping
Center will hold the City of Little Rock harmless of any
liability for damages to property if the City has to access
the drainage culvert under property built by the East
Roosevelt Shopping Center pursuant to the requested
variance.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement on the date first written above.

To Whom It May Concern:
This letter is for clarification of structual design of the above referenced
project.
We will have our engineer design structual grade beams that will extend out
from existing building (east side) westward across existing box culvert for
the purpose of supporting exterior walls and roof load.
The west wall will be supported by footing. This footing will be 31 feet west
of existing building and will not affect existing box culvert.
The only -load applied to existing box culvert will be 4 inch concrete floor
slab which will be pour over existing asphalt.
Since existing box culvert is supporting parking lot traffic at this time, it
would seem that the proposed addition's floor slab would be less load.
If I can be of additional help please advise,
