NEW ST.: 0 A. Proposal/Request 1. To construct a 2,000 square foot, two-story, single family home on a lot that contains 6,266 square feet. 2. The construction of a swimming pool in the rear. B. Existing Conditions This site is located in a single family area in one of the older neighborhoods of the City. C. Issues/Discussion/Legal/Technical/Design 1. Depart from usual lot size for single lot, single family development. 2. Proposal overbuilds lot. 3. May set precedent for other requests to divide lots. Five-foot additional right-of-way dedication required. E. Staff Recommendation Denial based on staff's comments. SUBDIVISION COMMITTEE REVIEW: The engineer agreed to widen the driveway and dedicate the requested five feet. PLANNING COMMISSION ACTION: There were objectors present. The application was represented by Mr. David Scruggs. Mr. Scruggs made a presentation. He offered a petition with 14 signatures of support for his application. He described his house and pool, the dimensions, height and relationship to neighbors. Mrs. Carolyn Gluckman was present to question the project. She stated that she had not been given the same information about this case earlier and only at this meeting did she receive a complete picture. She objected to the two-story construction with windows. Several Commissioners objected to the 15' carport setback. After a brief discussion involving the several parties, a motion was made to approve the PUD subject to provision of: °Z -51D05 - -Cont-inued (1) Six-foot brick wall around the deck and pool, (2) Access only from the house in front of the lot, (3) Delete the 15' carport line. A motion passed by a vote of 7 ayes,. -0 noes, 3 absent, 1 abstaining, Richard Massie. ORDINANCE NO. AN ORDINANCE APPROVING A PLANNED UNIT DEVELOPMENT AND ESTABLISHING A DISTRICT TITLED PROSPECT TERRACE SHORT -FORM "PRD" (Z-5005) IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING CHAPTER 43 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zone classification of the following described property be changed from "R-2" Single Family District to "PRD" Planned Residential District: Part of Lot 119, Prospect Terrace Addition, located in Section 31, T -2-N, R -12-W in Little Rock, Arkansas, more particularly described as follows: Commencing at the NE corner of Lot 119; thence westerly along the North line of said Lot 4 .1 feet; thence S 01° 25' 25" E, 138.30 feet; thence S 82° 21' 35" W, 44.50 feet; thence N 020 03' 36" W, 140.0 feet; thence N 84° 40' 10" E, 45.9 feet; to the point of beginning and containing 6,266.85 square feet or .144 acres more or less. SECTION 2. That the preliminary site plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Prospect Terrace Short -Form "PRD" is conditioned upon obtaining a final plan approval from the Planning Commission within the time specified by Article IX, Section 9.101 of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 43-1 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and it is hereby amended to the extent and in the respects necessary to effect and designate the change provided in Section 1 hereof_. SECTION 5. That this ordinance shall take effect and be in full force upon final approval of the plan by the Planning Commission. PLANNING COMMISSION ACTION: The application was presented by Mr. David Scruggs. Objectors from the neighborhood were in attendance. The Commission decided to pass the motion for approval by a vote of 7 ayes, 0 noes, 3 absent, and 1 abstaining, Richard Massie. The Commission gave several reasons for approving the item: (1) The lot will be only about 5 feet less in width than many of the other lots in the subdivision. (2) The new house will be compatible with the square footage of existing houses in the area. (3 ) The neighbors were not opposed to a house being built. Concern was expressed only about too large a house being built on the lot. After review, the Commission felt that the proposed house would be compatible with the neighborhood.
