STATEMENT OF PROPOSAL:
This applicant proposes a revision of the original PRD
application and amendment of the previously approved R&R
Residential Care facility. The proposal, as now drafted,
eliminates the residential care facility and the southeast
part of the project. In place of the residential care
facility, the developer proposes a day care center.
The phasing plan for this proposal is now changed to provide
for the day care center to be Phase I and the unknown
development to be Phase II. Access to the parking area at
the day care center facing Roosevelt Road is proposed as a
one-way drive in lieu of the original approved two-way
drive. This is proposed due to a change in character of
vehicle traffic on the site.

A. PROPOSAL/REQUEST:
This application involves the change of a previously
approved residential care center to a day care center.
The proposal as now drafted consists of basically the
same proposal on the southeast one-half of the block
with some minor modifications. The building now
proposed is one story in height, over 9000 square feet,
and located 64 feet from the property line. The
previous proposal incorporated two buildings tied to
the east and west boundary by a two-way traffic flow.
B. EXISTING CONDITIONS:
The property currently is vacant on the southeast which
is the principal area of involvement for this day care
center. The land has been cleared and leveled. The
only structure in place is a two-story residential care
building facing to the east on Wolfe Street.
C. ENGINEERING COMMENTS:
Dedicate 35 feet of right-of-way from center line on
Roosevelt; construct one-half of 45 foot pavement and
sidewalk on Roosevelt. These improvements will require
a variance request from the Master Street Plan
Principal Arterial requirements for Roosevelt Road.
Stormwater Detention and Excavation Ordinances apply.
D. ISSUES/LEGAL/TECHNICAL/DESIGN:
None of the issues, legal, technical or design problems
typically associated with a project of this size exist
in this application. There are some questions that
staff would like to deal with concerning changes from
the previous submittal. These have to do with the
absorption of traffic for a 9,000 sq. ft. day care;
provision of more safe parking and pick-up spaces;
inclusion of outside playground and the name Phase II
on the plan; and provision of a ccver letter describing
the development philosophy.

E. ANALYSIS:
The Planning staff review of this proposal has resulted
in a number of concerns. These are:
1. The primary east/west drive which was previously
designed to accommodate the health fitness
facility is now designed as a one-way flow to
parallel Roosevelt Road. This may be of some
concern to the Traffic Engineer. However,
specific comment has not been received.
2. The phases within this project have not been
shown. In the initial approval, the health
fitness facility was the primary objective for
construction, and that was to be the first phase.
This plan alters the approach to one of
constructing this day care facility as Phase I.
3. Additionally, staff has concerns about the size of
the day care. We would suggest reducing the
building size, including an outside playground,
and proposing more parking spaces.
F. STAFF RECOMMENDATION:
The staff reserves its recommendation on this item
until the Subdivision Committee meeting in order to
further develop information concerning the proposed
building size and Phase II development.
SUBDIVISION COMMITTEE COMMENTS: (November 30, 1989)
The applicant was not in attendance. The Planning staff
informed the Subdivision Committee of the site plan
deficiencies, unanswered questions and lack of letters
describing the development philosophy.
The Planning staff was instructed by the Commissioners to
call Mrs. Ruffin to ask her to provide additional
information by Thursday of the week before the Planning
Commission meeting. If not, the item will be deferred to
the next scheduled meeting.
The Committee forwarded the matter to the full Commission
without additional comment.

PLANNING COMMISSION ACTION: (December 12, 1989)
The Planning staff reported to the Commission that Mr. Rose
Ruffin, the applicant, had failed to bring the notices to
the adjacent owners as required by the Bylaws. However,
staff recommended approval of Phase I if the applicant
agreed to present a copy of the letter, the list of names
from the abstract company and certified mail receipts the
next, day before 10:00 a.m. Staff also added that additional
right-of-way, one-half of 45 feet pavement, and sidewalk on
Roosevelt Road will be required.
The Chairman then asked Mr. Hahn to present his application.
He stated that he agreed with all staff recommendations and
he is willing to comply with staff's requests.
The motion was then made to approve Phase I subject to
submittal of notices, copy of letter and list from abstract
company, the next day before 10:00 a.m. to the Planning
office. The motion passed by a vote of 10 ayes, 0 noes,
1 absent.

This application proposes the amendment of the previously
approved R & R Residential Care Facility. The proposal, as
now drafted, eliminates the child daycare facility on the
west corner of the project. In place of the child care
facility is proposed a two-story health fitness center.
The phasing plan for this proposal is now changed to provide
for the health fitness center to be Phase I and the
residential care facility to be Phase II. The health
fitness facility is projected for a completion date within
three to five rnonths of final development plan and plat
approval.

GENERAL OBJECTIVE:
It is proposed to consolidate 1.66 acres of individually
zoned Parcels of property under a single PUD District for
the purpose of unif;ed, controlled development compris;ng a
health fitness f4cility and a residential care facility.
Thi development vriii fulfill the need for individual human
fitneso and Health care services.
HEALTH FITNESS FACILITY OBJECTIVE:
The proposed health fitness facility offers to children and
adults instructional programs in exercising, gymnastics,
martial arts, aerobics and dance. In addition to the
instructional programs, a physical therapy program will be
offered for the residential care facility. The student load
Shall be 100 with a maximum of 40 adults at any one time
Plus a maximum of 60 children below the age of 18. The
facility staff shall comprise five individuals including
three certified and/or licensed instructors, an
administrative secretary and the director.

The proposed residential care facility is represented in
this plan in the same form as previously approved. The
facility offers the needed housing for those individuals
