3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE
4 CHAPTER 15 (1988), LANDSCAPING AND TREE PROTECTION; AND
5 FOR OTHER PURPOSES.

7 WHEREAS, a stated purpose and intent of Little Rock, Ark., Rev. Code Chapter 15, Landscaping
8 and Tree Protection ("Landscape Ordinance") is to "[e]ncourage green/sustainable practices as a purpose
9 to aspire towards for all applicable landscape projects; and,
10 WHEREAS, non-native invasive plant species have the potential to overpopulate and negatively
11 affect their environment by causing ecological, environmental, or economic damage and placing existing
12 native plant species at risk of extinction; and,
13 WHEREAS, the Little Rock Sustainability Commission consulted a team of diverse stakeholders
14 who identified non-native plant species which are recommended on the existing Landscape Ordinance
15 that warrant restrictions based on the economic and environmental harm that they cause; and,
16 WHEREAS, on February 23, 2023 the City Beautiful Commission voted to recommend changes to
17 the City's Landscape Ordinance in order to restrict the use of invasive plant species in commercial
18 landscapes due to invasive plant species' interference with the ecosystem and natural habitats and in order
19 to have more plant species native to the area; and,
20 WHEREAS,there is now a desire to amend the Landscape Ordinance accordingly.
21 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK,ARKANSAS:
23 Section 1. Little Rock, Ark., Rev. Code Sec. 15-6. — Definitions, is hereby amended to add a new
24 definition, "Invasive Plant Species",as follows:
25 Invasive Plant Species means plants that are not indigenous or native to a particular area and able
26 to establish on many sites, grow quickly and speared to the point of disrupting plant communities
27 and ecosystems, further identified as invasive in Section 15-106.
28 Section 2. Little Rock, Ark., Rev. Code Sec. 15-6. — Definitions, is hereby amended to add a new
29 definition, "Native Plant Species", as follows:
30 Native Plant Species means one that occurs naturally in a particular region, ecosystem or habitat
31 without direct or indirect human intervention. The plants present at the time Europeans arrived in
32 North America are considered native to Arkansas.
33 Section 3. Little Rock, Ark., Rev. Code Sec. 15-86. — Generally, is hereby amended to read as
34 follows:

1 Plant material used for compliance with the provisions of this article shall conform to the
2 "American Standards for Nursery Stock, 1-73," Grade No. 1, American Association of
3 Nurserymen, Inc., or equivalent. Plant material which may be installed in vehicular use areas are
4 defined and should be selected from applicable lists. It is the intent of this division to be flexible;
5 thus the responsible party may select plants not listed in this division for landscaping vehicular
6 use areas other than the public rights-of-way as long as the substitute plants can withstand harsh
7 weather conditions, comply with all other provisions of this Chapter, are not listed as invasive in
8 Section 15-106, and are approved by the City Official.
9 Section 4. Little Rock, Ark., Rev. Code Sec. 15-87. — Tree species and Hillside Plantings,
10 Subsection(d),Shrubs for Terraces on Hillside Cuts, is hereby amended to read as follows:
11 (d) Shrubs for Terraces on Hillside Cuts.

2 Section 6. Little Rock, Ark., Rev. Code Sec. 15-89. — Shrub Species, Subsection(a),Recommended
3 List, is hereby amended to read as follows:
4 (a) Recommended List. The following list of shrubs are those which have been found to be best
5 suited to this area and require the least amount of maintenance.This list includes those shrubs
6 which may be planted in the required landscaping area. For any site, shrubs from two (2)
7 different genuses are required. At least 25%of the shrubs on the site outside of those required
8 for screening purposes are to be of evergreen variety.

2 Section 9. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
3 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
4 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this
5 ordinance,as if such invalid or unconstitutional provision was not originally a part of this ordinance.
6 Section 10.Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
7 ordinance are hereby repealed to the extent of such inconsistency.
