This morning, in response to your letter and phone call, I
visited the site of the proposed Alltel project where I
photographed the existing antenna. The photograph you furnished
of the proposed antenna appears to portray an antenna which is
substantially the same as the existing antenna. This antenna,
then, may be placed at the top of the existing tower in lieu of
the antenna which in place at this time.
This will confirm that based on the site plan submitted by
Alltel, dated May 18, 1993, with the job name "Gavin Arkansas", a
building permit may be granted for the prefabricated equipment
shelter, the 8' wood privacy fence, and the new antenna on the
existing tower.
An amendment to the PCD to permit a new tower has been placed on
the Planning Commission agenda of July 27, 1993. If approved,
the item will be placed on the Board of Directors agenda of
August 3, 1993. If the amended PCD is approved by the Board of
Directors, a permit may be granted for the new tower/antenna
base. Fifteen days prior to the Planning Commission meeting,
notification of property owners within 200 feet must have been
made, and a notice must have been placed on the property. The
posted notice may be picked up in my office.

By letter dated June 16, 1993, you forwarded to me a representation of a proposed antenna
for the referenced PCD location. You indicated that in lieu of the nominal seven (7) foot
antenna base, as approved on the PCD Site Plan, Alltel was now requesting a twelve (12)
foot antenna base.
I have consulted with Mr. Richard Wood, Manager of the Zoning and Subdivision
Division, and have confirmed that the installation of the antenna as presented will entail
amending the PCD. The difference in antenna base size is beyond what can be approved at
the staff level.
The next Planning Commission agenda at which this amendment can be heard is the
August 24, 1993 agenda. The cut-off date for filing of an application for this agenda is July
19, 1993. Filing of this application would not delay Alltel in making application for a
building permit to construct the building and fence based on the existing approved PCD
site plan.

Please find enclosed a foundation plan and a representative
picture of for the proposed tower at the above referenced
address and for the PCD. It differs from the previous tower
base in that instead of being a solid concrete structure, it
has concrete piers for each tower leg and has a larger
footprint. The replacement tower will not be higher, neither
will it be different at the top than the existing tower, but
the base dimension is required to make the tower "tornado
proof".
The addition of the decorative fencing at the site should
block the view of the lower portion of the tower from Kanis
road and the positioning of the adjoining house should
largely block the view of the tower from Michael Drive. These
improvement's should preclude any complaints from the
neighbors regarding the tower.

Dear Mr. Sherwood:
Ordinance 15,819, passed February 20, 1990 established the
referenced PCD. The approved site plan shows at 20 foot by
45 foot proposed building to the west of the existing
building and parallel to the west property line. It also
shows the radio tower at the north-west corner of the
existing building.
The site plan submitted by you and prepared by Alltel Mobile
dated May 18, 1993 with a job name of "Gavin Arkansas" has
been reviewed. The 12.foot by 28 foot building, as located
on the site plan, falls within the building area provided in
the PCD site plan. The building may be placed as shown on
the Alltel site plan.
Since the approved site plan shows a radio tower in
substantially the same location as the proposed tower, and
since the existing tower is to be removed when the new tower
is installed, replacing the existing tower is approved. The
proposed tower may not be higher, be larger at the base, or
be substantially different at the top than the existing
tower.
The fence, as shown, is not an issue, and may be installed.
Any further modifications to the approved PCD site plan must
be reviewed by the Planning Commission and approved by the
City Board of Directors. Adequate time must be allowed for
this approval process.

Please find enclosed a copy of a site plan for the proposed
placement of the tower and equipment building for the above
referenced file.
According to the approvals already given under the above
referenced file numbers, our plan of locating a 12' x 28'
equipment shelter and re -locating a 120' tower on this site
should be within the approvals already granted by the
planning commission. For a short period of time, not expected
to exceed three weeks, two towers will exist on the site
while one of the two is under construction. The "old" tower
will be dismantled as soon as the "new" tower is in place.
The dashed line designated as "proposed shop" is the future
improvement that we hope to address before the planning
commission after a decision is made to fund that project.
Thellshop is not part of he current request for approval.

Dear Bob:
It has been decided by my client, ALLTEL Cellular
Associates of Arkansas Limited Partnership ("ALLTEL"), that a
monopole structure will be used at the above -captioned property
location rather than an open -lattice, self-supporting tower.
This decision was based upon the limited areas available at the
present site for the wider tower base which ALLTEL would need
for a self-supporting tower. The monopole will be 100 feet in
height. As is typical with all monopoles, it will have one
platform at the top which will support antennae for cellular
telephone use. It will most likely have a second platform near
the top with small antennae for uses consistent with the
current use of the existing tower.
Due to the fact that a monopole structure is a less
intrusive structure than the existing tower, I am writing this
letter to request that this matter be approved at the staff
level of the City of Little Rock Department of Neighborhoods
and Planning. It is my belief that this matter can be approved
by staff as an improvement to the current PCD and does not
necessitate Planning Commission or City Board approval.

Our firm represents ALLTEL Mobile Communications, Inc. I
am in receipt of your letter to Mr. Michael Sherwood dated June
8, 1993. Your letter gave staff approval to the site plan
submitted by ALLTEL Mobile dated May 18, 1993.
As you are aware, ALLTEL Mobile has determined that the new
tower to be constructed on the property must have a triangular
base with three equal sides measuring 11'6" each. It is my
understanding that the planning staff has determined this
matter must be submitted to the Planning Commission for
approval as a short -form PCD.
I would like to request that you place this matter on the
first available Planning Commission Agenda as you discussed
with Cathy Kurfess of ALLTEL and me last week by telephone.
Please let me know of any additional requirements which ALLTEL
Mobile or I need to do to facilitate the application and
approval of this matter.
During the interim, ALLTEL Mobile would like to construct
the 12' x 28' building as previously approved by staff and as
referenced in your June 8, 1993 letter. Additionally, ALLTEL
Mobile will temporarily use the tower presently located on the
property. It will be necessary to place antennae at the top of
the tower which will resemble the antennae pictured in the
enclosed photograph.

I would appreciate your response to this request with staff
approval of the plans in writing as soon as possible.
Additionally, I appreciate your assistance in pursuing the
short -form PCD.

This will acknowledge receipt of your Fax dated July 9, 1993, relating new information
concerning the proposed antenna at the 8434 Kanis Road PCD.
If the antenna tower is, as is proposed, a monopole structure rather than an open -lattice
tower; and, the tower is not taller than the 120 foot height approved for the site, then Alltel
may proceed with an application for the building pernut for each of the items presented to
date: the 12 foot by 28 foot prefabricated equipment shelter, the 8 foot wood privacy fence,
and the monopole antenna structure with antenna as presented in your correspondence of
June 29, 1993, including the two antenna support platforms.
Proceeding with the course of action identified, the City staff's position is that the item can
be,' and is, approved at the staff level and does not need to be heard by the Planning
Commission or Board of Directors. The item will be removed from the Planning
Commission agenda. Removal of the existing antenna tower will be required prior to a
certificate of occupancy being issued for the new facility.
