HomeMy WebLinkAbout15957 1 RESOLUTION NO. 15,957 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO VARIOUS CONTRACTS TO DEAL WITH STORM DAMAGE AND 5 DEBRIS, ALONG WITH DEBRIS MONITORING, FROM THE MARCH 6 31, 2023, EF-3 TORNADO THAT SEVERALLY DAMAGED VARIOUS 7 SECTIONS OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR 8 OTHER PURPOSES. 9 10 WHEREAS, on March 31, 2023, an EF-3 tornado sliced through the City of Little Rock,Arkansas 11 ("the City")and demolished,or otherwise damaged,numerous properties within the City,including homes, 12 businesses, and natural areas with strong winds that uprooted trees, destroyed roofs, and made certain 13 portions of the City inaccessible for a brief period of time;and, 14 WHEREAS,on April 1,2023,Arkansas Governor Sarah Huckabee Sanders declared that the City was 15 a Natural Disaster Zone; and, 16 WHEREAS,on April 1, 2023, Mayor Frank Scott,Jr., declared a Natural Disaster Emergency within 17 the City; and, 18 WHEREAS, on April 2, 2023, President Joseph Biden declared that the City was part of a National 19 Disaster Zone; and, 20 WHEREAS, these declarations make the City eligible for financial and other assistance from the 21 Federal Emergency Management Agency provided the City employs a debris removal monitor to oversee 22 aspects of the recovery work; and, 23 WHEREAS, on April 4, 2023, and April 6, 2023, the City issued Request for Proposals to solicit 24 eligible bidders, selected by the lowest responsible and responsive bid, in Bids No. 2101, 2102,2103, and 25 2106, to include the removal and disposal of storm debris in separate parts of the City, and the separate 26 provision of debris monitoring services; and, 27 WHEREAS,these bids were opened on April 10,2023,and four(4)entities will be named as the most 28 qualified lowest responsible and responsive bidders,and thus the recipients of these bids;and, 29 WHEREAS,time is of the essence to enter into these contracts and to assure that this recovery work 30 continue in an expedited fashion; and, 31 WHEREAS, before contracts are actually entered it is essential that individual bid amounts are 32 confirmed to ensure the most qualified lowest responsible and responsive bid is selected. 33 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 34 OF LITTLE ROCK,ARKANSAS: [Page 1 of 31 r 1 Section 1. The City Manager is authorized to enter into a contract with a vendor pursuant to Bid No. 2 2101,for debris removal and disposal caused by the March 31,2023,tornado in the area marked Section A 3 of the City in an amount to be ratified at the next meeting of the Board of Directors,but which is approved 4 by a Committee of the Departments of Finance, Public Works, Parks & Recreation and Emergency 5 Management,as the lowest responsible and responsive bid to do this work. 6 Section 2. The City Manager is authorized to enter into a contract with a vendor pursuant to Bid No. 7 2102,for debris removal and disposal caused by the March 31,2023,tornado in the area marked Section B 8 of the City in an amount to be ratified at the next meeting of the Board of Directors,but which is approved 9 by a Committee of the Departments of Finance, Public Works, Parks & Recreation and Emergency 10 Management,as the lowest responsible and responsive bid to do this work. 11 Section 3. The City Manager is authorized to enter into a contract with a vendor pursuant to Bid No. 12 2103,for debris removal and disposal caused by the March 31,2023,tornado in the area marked Section C 13 of the City in an amount not to be ratified at the next meeting of the Board of Directors, but which is 14 approved by a committee of the Departments of Finance, Public Works, Parks & Recreation, and 15 Emergency Management, as the lowest responsible and responsive bid to do this work. 16 Section 4. The City Manager is authorized to enter into a contract with a vendor pursuant to Bid No. 17 2106,to monitor debris removal and disposal caused by the March 31,2023,tornado within the City in an 18 amount to be ratified at the next meeting of the Board of Directors,but which is approved by a Committee 19 of the Departments of Finance, Public Works, Parks & Recreation and Emergency Management, as the 20 lowest responsible and responsive bid to do this work. 21 Section 5. The City Manager is to enter these contracts at the earliest possible time to assure the 22 prompt,efficient, and safe,removal of debris,and its disposal,caused by the March 31,2023. 23 Section 6. Funds for these contracts are available in the Fund No. S100535-Disaster Relief 2023 24 Tornado and FEMA 270409DF231. 25 Section 7. Severablity. In the event any title, section, paragraph, item, sentence, clause, phrase, or 26 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 27 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 29 ordinance. 30 Section 8. Repealer.
