3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO AGREEMENTS WITH MID-ARK ROOFING, INC., ARKANSAS
5 MOLD AND WATER,INC.,AND ENERGY ROOFS AND WALLS,LLC,IN
6 AN AMOUNT NOT TO EXCEED ONE HUNDRED FIFTEEN THOUSAND
7 DOLLARS ($115,000.00),FOR PROFESSIONAL MOLD ABATEMENT AT
8 THE LITTLE ROCK ZOO AMPHITHEATRE; AND FOR OTHER
9 PURPOSES.

11 WHEREAS,the Little Rock Zoo Amphitheater has been found to contain large quantities of mold that
12 poses a great health risk to humans and the surrounding animals; and,
13 WHEREAS, on March 22, 2023, the Zoo received a competitive requirement exemption for an
14 emergency procurement project with the Little Rock Zoo Amphitheater("Amphitheater");and,
15 WHEREAS,the exemption was granted pursuant to Arkansas Code § 14-58-104 'Any commodities
16 needed in instances in which an unforeseen and unavoidable emergency has arisen in which human life,
17 health,or public property is in jeopardy'; and,
18 WHEREAS,the Zoo request contracts with Mid-Ark Roofing, Inc., Arkansas Mold and Water Inc.,
19 and Energy Roofs and Walls, LLC, to receive professional mold abatement at the Amphitheatre, which
20 includes removal of the existing roof,abatement and replacement of the roof and any other affected portions
21 of the building; and,
22 WHEREAS, the total cost of the project shall not exceed One Hundred Fifteen Thousand Dollars
23 ($115,000.00) and shall be applied to Mid-Ark Roofing, Inc., in the approximate sum of Eighty-Five
24 Thousand Dollars ($85,000.00), Arkansas Mold and Water, Inc., in the approximate sum of Sixteen
25 Thousand,Five Hundred Dollars($16,500.00),and Energy Roofs and Walls,LLC, in the approximate sum
26 of Seven Thousand Dollars ($7,000.00), with an additional sum of Six Thousand, Five Hundred Dollars
27 ($6,500.00)to be held in reserve to remedy unforeseen costs.
28 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
29 OF LITTLE ROCK,ARKANSAS:
30 Section 1. The City Manager is authorized to enter into Agreements with Mid-Ark Roofing, Inc., in
31 the approximate sum of Eighty-Five Thousand Dollars ($85,000.00), Arkansas Mold and Water, Inc., in
32 the approximate sum of Sixteen Thousand, Five Hundred Dollars ($16,500.00), and Energy Roofs and
33 Walls,LLC, in the approximate sum of Seven Thousand Dollars($7,000.00)to provide Professional Mold
34 Abatement at the Little Rock Zoo Amphitheatre.

1 Section 2. Contract Funding of One Hundred Eight Thousand, Five Hundred Dollars ($108,500.00)
2 for this project is available in the Arkansas State Parks Grant — Zoo, Accounts No. 10869-S65G012 and
3 326659-TS65A322 and an amount of Six Thousand,Five Hundred Dollars($6,500.00)to be held in reserve
4 to remedy unforeseen costs.
5 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
6 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
7 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
8 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
9 resolution.
10 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent with this resolution are
11 hereby repealed to the extent of such inconsistency.
