3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO AN AGREEMENT WITH TOTER, LLC, IN AN AMOUNT NOT TO
5 EXCEED TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000.00),
6 FOR THE PURCHASE OF GARBAGE CART CONTAINERS FOR SOLID
7 WASTE CUSTOMERS,LOCATED WITHIN THE CITY OF LITTLE ROCK,
8 ARKANSAS; AND FOR OTHER PURPOSES.

10 WHEREAS, the Public Works Department Solid Waste Division utilizes Ninety-Six (96)-Gallon
11 Garbage Carts for garbage collection for Solid Waste Customers, located within the City of Little Rock;
12 and,
13 WHEREAS, the Public Works Department will utilize Sourcewell Government Purchasing
14 Cooperative Agreement,Contract No. 004521 TOT,to enter into a contract with Toter,LLC,for a Garbage
15 Cart Purchase Contract.
16 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. The City Manager is authorized to purchase Garbage Carts utilizing the Sourcewell
19 Government Purchasing Cooperative Agreement, Contract No. 04521TOT, for the Public Works
20 Department's Solid Waste Services Division, in an amount not to exceed Two Hundred Fifty Thousand
21 Dollars ($250,000.00), for a period of one (1)-year, to be utilized for garbage collection for Solid Waste
22 Customers.
23 Section 2. Funds for this purchase are allocated in Account: Solid Waste Enterprise Fund Account
24 No. 603110-60170.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
29 resolution.
30 Section 4. Repealer. All laws,ordinances,resolutions, or parts of the same,that are inconsistent with
31 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
