This rezoning application is the result of a enforcement action because of a use that is not permitted in the "I-2" district locating in one of the structures on the site. A majority of the uses on the east side of Rebsamen Park Road are more commercial or retail oriented and "C-3" appears to be appropriate reclassification for the property. The area between Rebsamen Park Road and the railroad tracks is primarily zoned "I-2" but over the years, there have been "C-3" rezonings similar to the issue at hand and those reclassifications have not had any adverse affects on any of the surrounding properties. The Heights/Hillcrest Plan identifies land west of the tracks for commerical uses so the request is not in conflict with any plan element. Engineering reports that right-of-way and street improvements will be required on issuance of a building permit and the 100 year flood elevation on the east side near the railroad tracks should be shown in order to properly set the floor elevations. (Two buildings are currently located on the two lots). STAFF RECOMMENDATION Staff recommends approval of the "C-3" as filed. The Commission determined that the notice had not been met as required by the bylaws due to the inability of the owner to obtain an abstract company list. A motion to defer the application to August 26 was made and passed by a vote of•8 ayes, 0 noes, 3 absent. PLANNING COMMISSION ACTION: (8-26-86) The applicant was present. There were no objectors. A motion was made to recommend approval of the "C-3" request. The motion passed by a vote of 11 ayes, 0 noes and 0 absent.
