PLANNING CONSIDERATIONS
1. The proposal is to rezone the property in question to
"0-3" to permit parking and some accessory buildings
for a trade school to be located on the adjoining 11I-2"
tract. It is the staff's understanding that the area
under consideration will be primarily used for parking
and offices for the school. Should the "0-3" rezoning
be granted, the proposed use will also require approval
of a conditional use permit. The site is located on
Lancaster Road, north of west 65th Street, and
adjacent to a well established single family
neighborhood. The land use along Lancaster is
primarily single family north of the existing "C-3" and
"C-4." The zoning in this area is 11R-2" with an
existing nonresidential zoning restricted to properties
that have frontage on West 65th Street. The land use
is very similar to the zoning with some exceptions such
as the "R-5" tract on the east side of Lancaster which
is used for single family residences. The "C-3" site
at the northwest corner of Lancaster and West 65th is
still undeveloped.
2. The site is vacant and wooded.
3. Dedication of additional right-of-way for Lancaster
will be required because the survey only shows an
existing right-of-way of 40 feet.

4. Engineering reports that:
. Right-of-way and street improvements are required
on Lancaster Road.
Storm detention is required.
No other adverse comments have been received from the
reviewing agencies..
5. There are no legal issues.
6. When the "I-2" parcel was rezoned, the neighborhood to
the north got involved and the 100 foot "R-2" strip is
the result of that action. There is no documented
history on the "R-2" Tract that fronts Lancaster Road.
7. Because of the property in question abutting "I-2"
zoning, an "0-3" reclassification appears to be
reasonable, especially since the two sites will be
developed under one site plan and staff supports the
general proposal. The "0-3" zoning if granted will
Provide for an adequate buffer between the single
family neighborhood to the north and the nonresidential
uses to the south. To reinforce this buffer concept,
staff suggests that at least the north 50 feet of the
land be left undisturbed. This should help protect the
quality of life in the subdivision to the north.
Additional review through the conditional use permit
process should also help address any concerns expressed
by the residents of the area.
STAFF RECOMMENDATION
Staff recommends approval of "0-3" for the site with the
north 50 feet being zoned "O -S" Open Space.
PLANNING COMMISSION ACTION: (7-22-86)
The applicant was present and offered comments in support of
his petition. He stated that he accepted the staff's
recommendation for the 50 -foot "OS" strip along the north
property line. There was one objector in attendance,
Mr. Walker, a resident of the street on the north.
Mr. Walker offered concerns about drainage runoff from this
project on to his lot and the neighborhood. The drainage
issue was discussed at length. It was determined that
Mr. Walker's property was not immediately adjacent to this
site and that this project would be building in a retention
system to prevent an increase in runoff. A brief discussion
of the proposal was followed by a recommendation of approval
as recommended by the staff. The motion passed by a vote of
8 ayes, 0 noes, 3 absent.

1 1. Obj e c for s: There was one interested person, Mr. Walker whose residence does
not abut the site but is affected by drainage from the site. The
Commission assured Mr. Walker that proper retention of water would
be required on the site to assure that no increase in runoff would
occur. That addressed his concern and he had no further comment.
