Bickerstaff Ascomb Enterprises, Inc. 13441 Cantrell Road Rezone from "R-2" to "C-1" Laundromat 0.30 acres Existing Use: Vacant building SURROUNDING LAND USE AND ZONING: North - Vacant and single family, zoned "R-2" South - Vacant, zoned "R-2" East - Single family, zoned "R-2" West - Single family, zoned "R-2" PLANNING CONSIDERATIONS: 1. The issue before the Planning Commission is to rezone two lots in the Pankey neighborhood from 11R-2" to "C-1" for the purpose of permitting a Laundromat. Land use along Cantrell Road (Highway 10) frontage in the area is primarily single family or vacant lots. There are some nonconforming uses in the neighborhood and there is a public school site on the north side of Cantrell Road. Zoning is "R-2" and "PRD" with the nearest commercial zoning situated approximately one-quarter mile to the west. To the east there is some office and multi -family zoning in place along Cantrell Road. 2. The site is two residential lots with one nonresidential building on it that is currently unoccupied and that has been its status for several years. 3. Cantrell Road is classified as a principal arterial on the Master Street Plan which requires a right-of-way of 110 feet. The existing right-of-way is deficient so dedication of additional right-of-way will be necessary. January 24, 1989 Item No. 1 -- Z -4624-A (Continued) 4. Engineering reports that the right-of-way standard for Cantrell Road is 110 feet or 55 feet from the center line on both sides. Dedication of right-of-way will be required through this rezoning action. 5. There are no legal issues associated with this request. 6. In 1986, a "C-1" application was filed for the same piece of property to permit a Laundromat. After several public hearings, the request was denied by the Planning Commission. With the first rezoning attempt, there were objectors and supporters present at the two meetings. Staff recommended denial of the "C-1" rezoning in 1986. 7. Staff's position is that nothing has changed since the 1986 application and does not endorse the current "C-1" zoning request. The adopted Highway 10 Plan shows the Pankey neighborhood to be kept as a residential area so the proposed commercial reclassification is contrary to the City's long-range goal for the area. Should the request be granted, it would create a spot zone and could have an adverse impact on the Pankey community and the Highway 10 corridor. Over the years and through many planning efforts, the residents of Pankey have always recommended that the residential character be maintained and there is no justification to change that direction at this time. STAFF RECOMMENDATION: Staff recommends denial of the request as filed. PLANNING COMMISSION ACTION: (January 24, 1989) The applicant, Ascomb Enterprises, Inc., was represented by Willard Proctor, Jr. There were several interested persons in attendance. Mr. Proctor gave a history of the area and said that the Pankey Community Development Block Grant Committee had voted to endorse the "C-1" request. He said the proposal would be a stimulus for the community and provide a needed service. He said the laundromat would conform to other uses and then answered several questions about the proposed development. January 24, 1989 Item No. 1 - Z -4624-A (Continued) Barbara Douglas, President of the Pankey Community Improvement Association, spoke and described the vote of the Community Development Block Grant Committee. Ms. Douglas told the Commission that several members of the Community Development Block Grant Committee had changed their minds and wanted to vote against the motion supporting the "C--1" request. Mr. Proctor made some additional comments about the neighborhood and the Highway 10 corridor. He also discussed the vote of the Community Development Block Grant Committee. Ms. Douglas responded to Mr. Proctor's comments and said that the residents of Pankey wanted to stay residential. She went on to say that the "C-1" rezoning was a spot zone and asked the Commission to keep Pankey "R-2." Zollie Wilkins offered an additional explanation about the vote and the Committee. Menervia Guest also made some comments about the vote and the meeting. Wendell Griffen, speaking for Harold Flowers, then addressed the Commission. Mr. Griffen said that the Highway 10 Plan showed Pankey to be residential and the Plan needed to be maintained. He said rezoning the property in question would place a lot of pressures on the Pankey residents because many were at the lower income scale. Mr. Proctor spoke again and responded to several of Mr. Griffen's statements. He said the rezoning would add to and enhance the neighborhood and reminded the Commissioners that the owners were from Pankey. A motion was made to recommend approval of the "C-1" request as filed. The vote was 0 ayes, 10 noes, 0 absent and 1 abstention (John McDaniel). The motion failed and the rezoning was denied.
