STATEMENT OF PROPOSAL:
The applicant proposes to add a small offices and training center
building to its current site. The proposed building is requested
to be located adjacent to the current office building; however,
the proposed location, although within the applicant's fenced
area, is within a 20 foot dedicated roadway along the boundary of
the site. This necessitates the request to abandon the right-of-
way of the boundary roadway.
A. PROP❑ AL RE UE T•
The applicant requests a site plan review in order to add an
additional building to its current site. The proposed
building is a 14 foot by 60 foot offices and training
facility, and is proposed to be located adjacent to and on
the north side of the applicant's offices building. The
proposed location is, however, within a 20 foot dedicated
right-of-way which runs the length of the north property
line, then turns and runs along the east property line
between the applicant's property and the railroad right-of-
way. The proposed location is also within the 15 foot side
yard setback which is required in the I-2 zoning district.
The building is proposed to be 14 feet wide; therefore,
almost all of the right-of-way and side yard setback are
encroached upon. A variance from the side yard setback is
requested and abandonment of the right-of-way is sought.

B. EXISTING CONDITIONS:
The site is currently zoned I-2. The applicant's offices
and industrial buildings occupy the northern portion of the
site; much of the site is undeveloped. Fourche Creek
borders the site to the west; the railroad and Arch Street
Pike border the site to the east. Sparsely developed
industrial tracts are to the south. Allied Way and its
warehouse uses are to the north.
C. ENGINEERING/DTILITY COMMENTS:
Engineering reports that the site appears to be in the
Floodway, and that no building permit can be issues. The
survey needs to clarify this information. It only indicates
that the property is in the 100 -year Floodplain. If the
building is permitted, a cul-de-sac needs to be constructed
at the end of Allied Way.
Water Works reports that on-site fire protections may be
required. Water Works indicates that they have a water line
easement across the property that is not shown on the
survey.
Wastewater Utility indicates that sewer service is available
and that the development will not adversely affect service.
Wastewater Utility has no objection to the abandonment of
the right-of-way.
The Fire Department approved the submittal without comment.
Southwestern Bell approved the submittal without comment.
D. ISSUES/LEGAL/TECHNICAL/DESIGN:
The proposed building needs to be properly dimensioned. The
distances from the building to property lines and to other
buildings needs to be shown.
The proposed building is located in a dedicated right-of-
way, and the right-of-way must be abandoned or the building
must be relocated.
The zoning district requires a 15 foot side yard setback.
The building is located within the setback; a variance is
required.
E. ANALY �:
The applicant's site is, at last report, located in the
designated Floodway. No further building may be
accomplished on the site.

F. STAFF RECOMMENDATIONS:
Staff recommends denial of the application.
SUBDIVISION COMMITTEE COMMENT:
(September 16, 1993)
No one was present to represent the applicant. Staff outlined
the request and the problem with the site being in the Floodway.
After a brief discussion, the Committee forwarded the item to the
Commission for final resolution.
PLANNING COMMISSION ACTION:
(OCTOBER 5, 1993)
Staff reported that a letter had been received from the applicant
in which the applicant requested withdrawal of the item. The
applicant had confirmed that the site is totally within the
federally regulated "floodway", and that no development is
allowed within the floodway boundary. The applicant indicated
that the proposed building plans would be abandoned. The item
was included on the consent agenda for withdrawal and was passed
by the Planning Commission with the vote of 8 ayes, no nays,
2 absent, no abstentions, and 1 open position.
