STAFF ANALYSIS:
The request before the Planning Commission is to grant
approval of a special use permit to allow a day-care family
home. The Zoning Ordinance defines a day-care family home
as:
Any facility which provides family -like child care in
the care giver's own family residence in accordance
with provisions of licensing procedures established by
the state of Arkansas and which serves no more than 10
children including the care giver's own children. Said
facility must obtain a special use permit in all zoning
ordinance where day-care centers are not allowed by
right.
The special use permit process is to provide a method of
control if a certain type of land use is not requiring a
full review but some review which allows for determination
of appropriateness within a neighborhood.
Based on a site visit of 5708 Meadowlark Drive, it appears
that the proposed use is reasonable for the location and
should have minimal impact on the surrounding properties.
The lot is a little over .4 acre in size so it has adequate
yard area and a fairly long driveway which allows for a
satisfactory drop off point. Restricting the use to 10

children or less the street will be able to accommodate the
slight increase in traffic flow.
Staff feels the proposed use is appropriate for the site and
supports the special use permit request. As of this
writing, staff has not received any adverse comments from
affected neighbors.
STAFF RECOMMENDATION:
Staff recommends approval of the special use permit.
PLANNING COMMISSION ACTION:
The applicant was present. There were no objectors. The
Commission voted to recommend approval of the special use
permit as requested. The vote: 10 ayes, 0 noes and
1 absent.
