Clark/Russell H. Clark PROPOSAL: To construct a retail facility and an auto parts sales and limited service facility (11,840 square feet total) and 38 parking spaces on .8 acres of land that is zoned "C-3." ORDINANCE DESIGN STANDARDS: 1. Site Location Located at the intersection of two major arterials (12th Street and South University). 2. Compatibility with Neighborhood This site is located in the mixed use area. Commercial uses are located to the north and west with single family uses located to the south and east. This proposal is compatible with the Oak Forest neighborhood plan and if properly developed, could be compatible with the surrounding area. 3. On -Site Drives and Parkin The proposal calls for one direct access to South University and indirect access to West 12th Street through the adjacent commercial use. Thirty-eight (38) parking spaces have been proposed. 4. Screening and Buffers A landscape plan has been submitted and shows a planter strip between the site and single family areas to the south and east. .• December 17, 1985 SUBDIVISIONS Item No. 25 - Continued 5. Analysis The staff is generally supportive of this proposal. The staff does, however have some concerns about reducing the impact to the adjacent single family areas. The staff feels that the site plan should be revised to include a possible screening- fence and a more specific landscape area on the south and east of the property. The staff also feels that all outside storage should be oriented away from the single family areas. The site plan meets all other ordinance requirements. 6. City Engineering Comments (1) Coordinate right-of-way dedication and boundary street improvements with the City Engineering staff based on the University corridor plan. (2) On-site stormwater detention is required due to existing flooding downstream adjoining property. STAFF RECOMMENDATION: Approval, provided the applicant agrees to: (1) screen and landscape the adjacent single family areas as outlined; and (2) comply with City Engineering Comments 1 and 2. SUBDIVISION COMMITTEE REVIEW: The applicant was present and agreed to comply with staff recommendations. The applicant also presented a revised site plan which included a screening fence on the south and west property lines. A lengthy discussion ensued over exactly what the proposal was to be. The applicant also agreed to submit a revised site plan that would orient the dumpster away from the single family area and reflect exactly what they are proposing to do. The - staff stated that they had received a revised site plan that included 20 additional parking spaces, a dumpster site adjacent to the building, a 5,250 square foot basement area under the retail building and a 3,000 square foot basement under the Goodyear Store. The applicant stated that the basement area would be used only for storage. The Commission then voted 8 ayes, 0 noes, 3 absent to approve the application, including the revised site plan as recommended by the staff, reviewed by the Subdivision Committee and agreed to by the applicant. The request is to rezone the property to "C-4" to allow a Goodyear store. This will be the Goodyear store that is currently located at Park Plaza, but will have to relocate because of the future plans for Park Plaza. The site is situated at the southeast corner of West 12th and University, a major intersection with a very heavy traffic flow. There are a number of nonresidential uses in the immediate vicinity with a large single family neighborhood to the southeast. The zoning includes "R-2," 110-2," "O-3," "C-3," "C-4" and "I-2" with "C-3" being the predominant nonresidential classification. The "C-4" that is directly north of the property in question is currently vacant, but some type of building is planned for the near future. Because of the site's location, it does lend itself to the use that requires high visibility such as Goodyear store, but at the same time it is a piece of property that has some unique circumstances that should be reviewed prior to the project being built. 2. The site is currently vacant and drops off dramatically from the University Avenue frontage to the east. There have been no adverse comments received from the reviewing agencies as of this writing. S� -There are no legal issues. 6. There is no documented neighborhood position or history on the site. 7. Staff's position is that the use is appropriate for the location, but has some reservations about "C-4" for the property. The use is not the issue but rather how the site is utilized and developed because of abutting some single family lots to the east and also some potential access problems. Staff is concerned that a "C-4" rezoning does not provide the necessary review to ensure that there will be no impact on the residential neighborhood and the site can accommodate the proposed use. The location gives the property good visibility, but it also makes the site somewhat difficult to work with. Because of these concerns, staff is recommending that the request be converted to a conditional use permit to allow for additional review of the site plan. The use, auto parts sales with limited motor vehicle parts installation, is a conditional use in "C-3." No tire or service work will be preformed in the rear.
