I now have had a chance to meet with Bob Althoff and Chris Barrier, and Bob has had the chance to discuss the matters related to Lot 2 with senior management at Bancor i �, As I see it, we really have two issues: 1. TACO BUENO Bottom line, the bank cannot support the currently SALE/REPLAT proposed plan for Taco Bueno, or any other use inconsistent with the original sale to Dr. Vora for a hotel development, that would likely increase the normal business hours traffic around and across their existing bank branch site. The proposed development is not at all in keeping with the spirit of the original negotiations. This is precisely why the bank and their counsel established a Bill of Assurance at rlosing/replatting which gave them the right to approve any and all plans to be effected on Lot 2 including grading, leveling, signage, parking construction, retaining walls, utilities, landscaping and building construction. However, the bank remains fully committed to the original plan and use of the hotel development on Lot 2. 2. POSSIBLE EXPANSION / You supplied me with suggested amended language for ACCESS /AMENDED BILL the Bill of Assurance, which would allow cross access to OF ASSURANCE FOR Lot 2, as well as any other lands purchased by the owner HOTEL DEVELOPMENT of Lot 2 that would be adjacent to Lot 2. Simply stated, that amended language adds new property to our development, additional traffic and additional maintenance. It changes our deal dramatically. The bank cannot agree to those changes, which would burden its property with no benefit to offset that burden. The proposal would change the classification from R-2 to PCD. The campus of the Arkansas Farm Bureau Federation is directly across Kanis Road from the property mentioned above and one of the two access points to the Farm Bureau campus is on Kanis Road, directly across the street from the property at issue. This also happens to be the only access point that can be utilized by traffic from two directions. Due to the proximity of the drive to the intersection of Kanis and Shackleford, when the drive was installed approximately 12 years ago the City of Little Rock restricted the access from Shackleford Road to only vehicles traveling north. We concurred with that restriction at the time as we still concur due to safety issues of anyone attempting to tura left into the drive while traveling south on Shackleford. As the general area has developed during the 30 years Farm Bureau has been located at our current site, obviously traffic counts have increased many fold, both on Kanis Road and on Shackleford Road. In fact, the traffic load at the intersection of these two major streets has reached a level that makes it virtually impossible to turn left from Kanis into the Farm Bureau property at certain times during the day and also virtually impossible to tum left onto Kanis by individuals exiting our property at certain times during the day. Because of the limited distance from the Kanis Road drive into the Farm Bureau property to the KanislShackleford intersection, the left turn lane into the Farm Bureau property on Kanis is extremely limited. Should the rezoning be allowed as proposed, access to the Farm Bureau p:•operty will be even more difficult and dangerous due to traffic traveling west on Kanis attempting to turn left into the property being proposed for the rezoning. I strongly urge you to consider the safety of the approximately NX) employees who work at the Farm Bureau Center as well as the safety of the parents and 120 preschoolers who are enrolled at the daycare center on the Farm Bureau carnpus. In addition, it is not uncommon for groups both frons outside the organization and members of the organization from all over the state to utilize the meeting facilities that are made available at the Farm Bureau Center. The proposed development is not at all in keeping with the spirit of the original negotiations. This is precisely why the bank and their counsel established a Lill of Assurance at closing/replatti.ng which gave them the right to approve any and all plans to be effected on Lot 2 including grading, leveling, signage, parking construction, retaining walls, utilities, landscaping and building construction. However, the bank remains fully committed to the original plan and use of the hotel development on Lot 2. POSSIBLE EXPANSION / You supplied me with suggested amended language for ACCESS /AMENDED BILL the Bill of Assurance, which wuald allow cross access to OF ASSURANCE FOR Lot 2, as well as any other lands purchased by the owner HOTEL, DEVELOPMENT of Lot 2 that would be adjacent to Lot 2. Simply stated, that amended language adds new property to our development, additional traffic and additional maintenance. It changes our Ileal dramatically.
