Joshua Applicant: Muskie Harris Location: 4215 Asher Avenue Request: Rezone from 11I-2" to 11C-4" Purpose: Beauty shop and limousine service Size: 0.25 acres Existing Use: Beauty shop and limousine service SURROUNDING LAND USE AND ZONING: North - Commercial, zoned 11I-2" South - Office and industrial, zoned 11I-2" East - Industrial, zoned 11I-2" West - Vacant, zoned 11I-2" STAFF ANALYSIS: The issue before the Planning Commission is to rezone the southeast corner of Peyton Street and Asher Avenue from "I- 2" to 11C-411. Currently, there is one building on the property with a portion of the structure being utilized by a limousine service. The other part of the building will be occupied by a beauty shop after the rezoning is accomplished. Beauty shops are not listed in the 11I-2" district. Therefore, a commercial reclassification was filed to permit both uses. 11C-4" was determined to be the most appropriate classification because of the limousine service, which has outside storage of vehicles. A beauty shop is allowed in the 11C-4" district under "retail uses not listed (enclosed)". Zoning in the general area is 11R-311, 110-3110, 11C-3111 11I-2" and PCD with properties fronting on Asher zoned either 11C-3" or 11I-211. Land use is very mixed and includes residential,, office, commercial and industrial. Some of the land is still undeveloped and throughout the area there are a number of vacant buildings. Along Asher Avenue, the uses range from eating places to warehousing and there is no cohesive pattern to the location of the different types of land uses. 1 May 8, 1990 ITEM NO. 2 - Z-4537-]3 Continued Over the years, the City has endorsed a combination commercial and industrial rezonings with "C-31', "C-4" and 11I-2" being the appropriate districts. The proposed "C-4" reclassification maintains the established zoning configuration and the "C-4" conforms to the adopted plan, Fourche, which shows a commercial strip for Asher Avenue in this area. ENGINEERING COMMENTS: Asher Avenue is classified as a principal arterial, which has a right-of-way standard of 110 feet or 55 feet from the center line. The existing right-of-way is deficient, and dedication of additional right-of-way will be required. STAFF RECOMMENDATION: Staff recommends approval of the "C-4" rezoning as requested. PLANNING COMMISSION ACTION: (May 8, 1990) The Staff reported that the owner submitted a written statement requesting that the item be withdrawn without prejudice. A motion was made to withdraw the rezoning without prejudice. The motion was approved by a vote of 11 ayes, 0 nays and 0 absent.
