BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from 0-2 to POD: Lot 2, GCC Addition, to the City of Little Rock, Pulaski County, Arkansas. SECTION 2. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of tho ordinance which shall remain in full force and effect as if the portion so declared or adjudg invalid or unconstitutional was not originally a part of the ordinance. Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required 4Ordinance Resolution Approval Information Report Approved By Bruce Moore The request is a rezoning to POD to allow the subdivision of an existing 2.9-acre lot into two lots with lot areas less than the two -acre typical minimum requirement per the Highway 10 Design Overlay District. None. Staff recommends approval of the requested POD zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 6 ayes, 0 noes, 2 absent and 3 open positions. The Planning Commission reviewed the proposed POD request at its December 18, 2008, meeting. There were no registered objectors present. The Pankey Community Improvement District, the Coalition of West Little Rock Neighborhoods, all residents who could be identified located within 300 feet of the site and all property owners located within 200-feet of the site were notified of the Public Hearing. BACKGROUND The request is a rezoning to POD to allow the subdivision of an existing 2.9-acre lot into two lots with lot areas less than the two -acre typical minimum requirement per the Highway 10 Design Overlay District. Proposed Lot 2A will contain 1.33 acres and proposed Lot 2B will contain 1.57 acres. Lot 2A contains an existing 6,740 square foot office building and Lot 213 is proposed with a 8,000 square foot office building. The two lots are proposed to share a single ground mounted monument sign with a maximum height of 10 feet and a maximum sign area of 100 square feet. No new drives are proposed from Cantrell Road. Although the site plan does not fully comply with the typical Highway 10 Design Overlay District standards, staff does not feel the area of non-compliance will significantly impact the development or the corridor. The only variance from the Overlay is to allow lots less than two (2) acres. The ordinance states there shall be a minimum development tract size of not less than two (2) acres. The development is proposed to create two lots containing 1.33 and 1.57 acres, which are both less than the typical minimum standard. Lot 2A is developed with an office building meeting all the landscaping and setback requirements and Lot 2B is proposed complying with all setback and landscaping requirements typically imposed per the Overlay. Staff is supportive of the request. Staff does not feel the creation of office lots with lot sizes less than the two acre typical ordinance standard per the Highway 10 Design Overlay District will significantly impact the development or the area. In the general area around the Sam Peck/Cantrell Road intersection, there are several smaller office buildings on tracts which are less than two (2) acres in size. Staff believes it is appropriate to allow more dense development, utilizing smaller lots, within established nodes, including the office/mixed node around this intersection. The lots as proposed meet all other aspects of the Highway 10 Design Overlay District. To staff s knowledge there are no remaining outstanding technical issues associated with the request. Please see the attached Planning Commission minute record and site plan for the applicant's specific development proposal and the staff analysis and recommendation. 2 ORDINANCE NO. Addition POD DCI Project # 08-143 Dear Donna: Enclosed are our application materials for a Planned Office Development application for Lot 2 of G.C.C. Addition to the City of Little Rock. The following items are provided for your use: 1. Eighteen copies of the POD Site Plan. 2. Completed application forms. 3. Owner authorization affidavit. 4. Right-of-way agreement form. As we have discussed, the purpose of this POD application is to acquire approval to subdivide an existing 2.9 acre lot into two lots. There is no proposed development plan for the vacant western area at this time and the owner wishes to sell the existing developed portion in the eastern half of the lot, Planning Commission approval is required to allow the creation of lots that are less than 2 acres in size. The way this lot was previously developed, a subsequent additional building in the western half was obviously planned for the future. The Highway 10 DOD also requires there be only one building per lot. This current land use classification is Office and it is presently zoned 0-2, Office and Institutional District. Our proposed uses are requested to be 0-2 uses, in compliance with the existing zoning. Please contact my office if you have any questions or require additional information.
