The south portion of the alley 15 right-of-way, which is not being proposed for abandonment, serves as a service drive area for garbage 16 pick-up; and, 17 WHEREAS,the abandonment of this right-of-way will have no adverse impact on the public welfare 18 and safety. The Little Rock Fire Department submitted no negative comments to the proposed 19 abandonment request; and, 20 WHEREAS, the applicant submitted a letter from an abstract company states that the reversionary 21 rights rest in the City of Little Rock; and, 22 WHEREAS, all of the public utility companies have reviewed and approved the requested right-of- 23 way abandonment; and, 24 WHEREAS,there are no Master Street Plan issues associated with this abandonment request, as the 25 right-of-way is not classified as a collector street or higher. 26 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 27 OF LITTLE ROCK,ARKANSAS: 28 Section 1. The City of Little Rock, hereby releases, vacates and abandons the following rights-of- 29 way property located within the north 160 feet of the twenty (20)-foot wide alley right-of-way, located 30 within Block 176, Original City of Little Rock, block bounded by West 7th Street to the north, West 8th 31 Street to the south, South State Street to the west and South Gaines Street to the east. 32 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the Real Estate 33 Records of the Recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County, Arkansas. In the event any section, subsection, subdivision, paragraph, subparagraph, 2 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 3 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 4 ordinance,as if such invalid or unconstitutional provision was not originally a part of this ordinance. 5 Section 4. Repealer.
