TN Q_ ORDINANCE NO. 22 237 � In Official Records of Terri Hollingsworth Circuit/County Clerk 2 �, `�` : .'`s 4.irQ: PULASKI CO,AR FEE$20.00 G( Sig COUNT\‘%‘ 3 AN,',,O^RbINANCE TO ABANDON THE ALLEY RIGHT-OF-WAY 4 LOCATED WITHIN BLOCK 16, GILBRATER HEIGHTS ADDITION, 5 BLOCK BOUNDED BY ATKINS ROAD TO THE EAST (700 BLOCK) 6 AND THREE (3) UNDEVELOPED RIGHTS-OF-WAY TO THE NORTH, 7 SOUTH AND WEST (G-23-486), IN THE CITY OF LITTLE ROCK, 8 ARKANSAS; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the adjacent property owners request to abandon the ten (10)-foot wide alley right-of- 11 way located within Block 16, Gilbralter Heights Addition, block bounded by Atkins Road to the east 12 (700)block and three(3) undeveloped rights—of—way to the north, south and west;and, 13 WHEREAS,the applicant requests the abandonment of ten(10)-foot wide alley right-of-way located 14 with Block 16, Gilbralter Heights Addition. The block is bounded by Atkins Road to the east and three 15 (3) undeveloped rights-of-way to the north, south, and west. The alley right-of-way is approximately 400 16 feet in length and ten (10) feet in width, or 0.092 acres. The alley right-of-way is currently undeveloped 17 and mostly tree covered; and, 18 WHEREAS, all of the abutting properties are zoned R-2, Single-Family District, and are comprised 19 of sixteen (16) single-family lots. The alley right-of-way abandonment is requested in order to 20 incorporate the area of abandonment into the adjacent lots for single-family residential development; and, 21 WHEREAS,the abandonment of this right-of-way will have no adverse impact on the public welfare 22 and safety. The Little Rock Fire Department submitted no negative comments to the proposed 23 abandonment request; and, 24 WHEREAS, the applicant submitted a letter from an abstract company stating that there are no 25 reversionary clauses attached to the right-of-way requested for abandonment; and, 26 WHEREAS, all of the public utility companies have reviewed and approved the requested right-of- 27 way abandonment; and, 28 WHEREAS, there are no Master Street Plan issues associated with this abandonment request, as the 29 right-of-way is not classified as a collector street or higher; 30 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 31 OF LITTLE ROCK,ARKANSAS: 32 Section 1. The City of Little Rock, hereby releases, vacates, and abandons the following rights-of- 33 way property located at the ten (10)-foot wide alley right-of-way located within Block 16, Gilbralter !Page 1 of 21 1 Heights Addition, block bounded by Atkins Road to the east (700) block and three (3) undeveloped 2 rights-of-way to the north, south and west. The alley right-of-way is approximately 400 4 feet in length and ten(10)feet in width, or 0.092 acres. 5 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the Real Estate 6 Records of the Recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County,Arkansas. 7 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 8 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 9 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 10 ordinance,as if such invalid or unconstitutional provision was not originally a part of this ordinance. 11 Section 4. Repealer.
