From the area regulations of
Section 36-301(e) to permit
construction of a building addition
with a reduced rear yard setback of
13 feet. The Ordinance requires a
25 foot rear yard setback.
The proposed new tenant needs
additional office space and the
addition needs to be added to this
end of the building due to existing
mechanical and structural
conditions. This is the only
buildable area due to the existing
parking lot location and a 40 foot
platted front building line.
The building is currently occupied
by Wiltel, a data, voice and video
communications company.
Once the new addition is complete,
the entire building will be
occupied by a division of the State
Pollution Control and Ecology
Department.
Dedicate right-of-way to 30 feet from centerline of the
frontage road. This property will be subject to boundary
street improvements. The property is subject to stormwater
detention requirements.

B. Staff Analysis:
The applicant proposes to expand this existing 5,500 square
foot building by adding a 2,090 square foot addition. The
proposed addition will encroach into the required 25 foot
rear yard setback by 12 feet, leaving a 13 foot rear yard
setback.
Once construction is complete, the building will be used as
offices by the Department of Pollution Control and Ecology.
P.C. and E. needs the additional office space and due to the
existing mechanical and structural conditions as well as a
platted 40 foot front building line, this is the only
buildable area.
Although staff feels that the request is reasonable and
supports the variance, attention must be given to protecting
the single family homes which are located adjacent to this
property, to the south. A 6 foot tall screening fence
extends the length of the parking lot. The applicant should
extend that screen along the entire south property line to
shield the adjacent residences.
C. Staff Recommendation:
Staff recommends approval of the requested setback variance,
subject to the 6 foot tall screening fence being extended
along the entire length of the south property line.
BOARD OF ADJUSTMENT:

The applicant's representative, Pat McGetrick, was present.
There were no objectors present. Staff presented the item and a
recommendation of approval, subject to the 6 foot tall screening
fence being extended along the entire south property line.
Mr. McGetrick addressed the Board and stated he agreed with
staff's recommendation.
Mr. Mickey Gogus, of #8 Linkay Court, addressed the Board. He
stated that his property had suffered drainage problems as a
result of previous construction on this site and he wanted to
make sure that no other problems of that sort developed.
Mr. McGetrick stated that the applicant would work with Mr. Gogus
to address his existing drainage problems and to assure that no
additional problems develop.
A motion was made to approve the requested rear yard setback
variance as recommended by staff and subject to the applicant
working with Mr. Gogus to address drainage problems created by

construction on this site. The motion was approved by a vote of
7 ayes, 0 noes, 1 absent and 1 open position.
