3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ISSUE A SOLE-
5 SOURCE PURCHASE ORDER TO G& W DIESEL,IN AN AMOUNT NOT
6 TO EXCEED AN ANNUAL BUDGET OF TWO HUNDRED EIGHTY-FIVE
7 THOUSAND DOLLARS ($285,000.00), PLUS APPLICABLE TAXES AND
8 FEES, FOR AN ANNUAL CONTRACT FOR PIERCE FIRE TRUCK
9 PARTS AND SERVICE FOR THE FLEET SERVICES DEPARTMENT;
10 AND FOR OTHER PURPOSES.

12 WHEREAS, it is critical that the Fleet Services Department("Fleet") be equipped with reliable parts
13 and service tools for minor repairs and maintenance on Pierce Fire Trucks currently in the City's Fleet;and,
14 WHEREAS,G& W Diesel is the only authorized Pierce dealer in Central Arkansas; and,
15 WHEREAS, on March 15, 2022, the Board of Directors approved Ordinance No. 22,108, which
16 authorized the Sole-Source Purchase Order, Contract No. 589, with G & W Diesel for an annual
17 contract for Pierce Fire Truck Parts and Service with an Annual Purchase Order for a one (1)-year
18 term with two(2), one(1)-year renewal options, and this ordinance represents Year 2 of the three (3)-year
19 term; and,
20 WHEREAS,the Annual Budget for each one(1)-year term is not to exceed Two Hundred Eighty-Five
21 Thousand Dollars($285,000.00), plus applicable taxes and fees.
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. The Board of Directors hereby authorize the City Manager to enter into a one (1)-year
25 contract renewal extension with G& W Diesel for the purchase of Pierce Fire Truck Parts and Service for
26 an annual purchase amount not to exceed Two Hundred Eighty-Five Thousand Dollars($285,000.00),plus
27 applicable taxes and fees.
28 Section 2. The funding for the Annual Purchase Order is available in the various Fleet Maintenance
29 and Parts Accounts.
30 Section 3. Because G & W Diesel is the only distributor for the Pierce Fire Truck Parts and Service
31 meeting the Departments specifications, the Board of Directors declares it is impractical and unfeasible to
32 submit this purchase to competitive bids.
33 Section 4. Severability. In the event any title, section, paragraph, item, sentence,clause, phrase, or

1 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
2 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
3 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
4 ordinance.
5 Section 5. Repealer. All laws, ordinances,resolutions, or parts of the same,that are inconsistent with
6 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
