Guerrieri Applicant: Mark Dillman Location: 12,807 Kanis Road Request: Rezone from "R-2" to 110-3" Purpose: Office Size: 2.5 acres + Existing Use: Single Family SURROUNDING LAND USE AND ZONING: North - Vacant and Single Family, Zoned "R-2" South - Vacant, Zoned "R-2" East - Vacant, Zoned "R-2" West - Vacant and Single Family, Zoned "R-2" PLANNING CONSIDERATIONS: 1. The request is to rezone the property to "0-3" for an office, possibly a medical clinic. The site is located between Bowman and Gamble just west of the Point West Subdivision. This section of Kanis was recently annexed into City, and there are a number of nonconforming uses in the area, but this property is not one of those. The land in question is occupied by residential use. To the east, there is a strip of "C-3" zoning that was rezoned over a year ago. A small 110-3" parcel was left because of being in a different ownership. The site in question is just to the west, but it is separated from the commercial property by "R-2" and "MF -24" strips. 2. The site is wooded and occupied by several structures, including a single family residence. 3. Kanis Road is identified as a minor arterial so dedication of additional right-of-way will be required. 4. There have been no adverse comments received from the reviewing agencies as of this writing. The property was brought into the City by the court decision affecting the referendum area. 7. The area is addressed by the Suburban Development Plan does not identify the site for office use. The plan recognizes nonresidential use for the area to the east and draws a line at Timber Ridge, the street just west of the "MF -18" parcel on the north side of Kanis. Staff's position is that the line should be maintained and is opposed to the "0-3_" request. The property is somewhat removed from what would be a more viable office location, and the rezoning is inappropriate at this time. It appears that a zoning pattern has ben established with the previous action, and this property is 'beyond the area recognized for nonresidential uses. STAFF RECOMMENDATION: Staff recommends denial of the 110-3" request. PLANNING COMMISSION ACTION: The applicant, Mark Dillman, was present. There were no objectors. Mr. Dillman spoke and indicated that he was representing the owners and the proposed purchaser of the property. He said the plans were to convert the existing structure into a doctor's office primarily for rehabilitation type services. He then described other uses in the area which included a junkyard and used car lot. He said that the proposed use was compatible with the area. There was a lengthy discussion about existing land use and zoning. The buyer of the property then described the use in more detail and plans for renovating the existing structure. Jim Lawson of the Planninng staff discussed Kanis Road and the Suburban Development Plan. He said that the staff would prefer "O-1" instead of "0-3" at this location. The applicant then agreed to amending the application to "0-1." The Planning Commission voted on the request as amended. The vote - 6 ayes, 0 noes and 5 absent. The 110-1" rezoning was approved. The Planning Commission supported "0-1" for the following reasons: (1) existing uses in the area, (2) the location of the site and its relationship to the street system, (3) the existing nonresidential zoning to the east, and (4) no impact on residential areas. 1.
