The date of November 9, 2004, at 6:00 pm in the Board Meeting Room on the 11 Second Floor of City Hall, Little Rock, Arkansas, is hereby set as the date and time for a public 12 hearing on the question of whether to close a portion of Summit Road from Woodland Heights 13 Road to Fairview Road. 14 Section 2. The City Clerk is directed to publicize notice of this hearing in accordance with 15 state law. 16 Section 3. Severability. Little Rock, AR 72223 November 3, 2004 Mr. Bruce Moore Little Rock City Manager City Hall 500 West Markham Street Little Rock, AR 72201 RE: Proposed Rezoning and Change of Land Use for Pleasant Ridge Town Center File Numbers: LU04-01-04 & Z -4411-D Dear Mr. Moore: The Westbury Neighborhood Association is opposed to the change of zoning and land use of the more than 11 acres being requested by the developer in this application. We are opposed to the request for the following reasons: 1. It appears to be in violation of the City of Little Rock Subdivision and Zoning Ordinance; 2. It violates the hillside protection ordinance; 3. It will create traffic gridlock at this location; 4. It will negatively affect the residential properties located in the area. Violation of the City of Little Rock Subdivision and Zonin Ordinance Section 36-82 of the City of Little Rock Subdivision and Zoning Ordinance provides: The amendment process is designed to accommodate those changes in the map [rezoning] which not have an adverse impact on surrounding property. The approval of this development will have a negative impact on the neighborhoods behind it due to traffic congestion, the removal of the hillside, increased noise pollution and the placement of large retail establishments backing up to the neighborhood. Violation of Hillside Protection Ordinance The development will result in a 60 foot cut and removal of an entire hillside. This is in violation of the City of Little Rock's Hillside Protection Ordinance. To allow this size of cut will set a very bad precedent for the future. Traffic Gridlock Placing a development of this size on a single arterial will create traffic gridlock on Arkansas Highway 10 and in the neighborhood behind it by increasing traffic on highway 10 by at least 9,700 vehicles per day. According to the Little Rock Planning Commission Staff, "The surrounding arterial system is already at, near or above the desired design traffic volumes; thus any change in use that increases the traffic even a little is an issue." In addition to the problems on Highway 10, the creation of traffic gridlock at this location will encourage traffic to find an alternate route. The natural choice for that alternate route will be Pleasant Ridge Road, which has no traffic controls. This will further aggravate the traffic situation on that road. The development will also place the burden of an additional 4,200 vehicle trips per day on the neighborhood streets immediately behind it. This will have a very serious negative impact on the quality of life of the residences behind it. LAnd Use & Zoning As a member of the River Mountain Neighborhood Action Plan Steering Committee, the other members of the committee and I spent several months working with the Little Rock Department of Planning and Development in developing the land use and zoning plan for this area at the city's request. As a result of this work, the land use for this property was designated by the city in early 2003 as suburban office to provide a transition between the commercial development in the front and Cedar Branch Neighborhood and the other residential properties behind the proposed. The developer purchased the properties located on Summit Road while the designation of property's future land use was suburban office. The proposed development of a commercial development of this size at this location is inappropriate. Our decision to oppose this request was reached at an open meeting with all residents of the neighborhood being notified of the agenda. Over the course of two days, sixty-nine of our adult residents (our neighborhood has 71 homes) signed a petition in opposition to this development. The originals of these petitions will be submitted to the board by Citizens for Responsible Growth. (Enclosed are copies of the petitions.) Only one person in our neighborhood who has been contacted has refused to sign the petition due to that person's perception of increased shopping opportunities. There were several who were not home and we anticipate obtaining additional signatures. We respectfully request that this application be denied. Any suggestions made by myself have been dismissed with such remarks as, "you cannot put speed bumps on a collector street". "You cannot use three way stop signs to control traffic". And "we are looking at other options". In the traffic study prepared by the developer's engineer, several things stand out. The study was done using summer time data. The study did not include data for Saturday and Sunday traffic flows. Are the developments stores going to be closed on the weekends? This traffic study did not indicate the impact increased traffic would have on the emergency fire response. I understand the proposal is to develop a center with 300,000 sq. ft. of "high-end" shops and restaurants which will attract many shoppers. This would back up to Fairview Rd. and Woodland Heights! We do not want that near our homes! The rear exit will spill out onto Woodland Heights, which will encourage people to take a "short cut" down Pleasant Forest Drive or Sierra Forest. This will destroy our neighborhood. I am the principal at Jefferson Elementary School and I have lived on Pleasant Forest Drive for eleven years now. I raised my children in this neighborhood and now have grandchildren who enjoy playing here. The traffic on Pleasant Forest Dr. has steadily increased as well as the speed at which the cars fly over the hill and past my home. This is very dangerous for children playing in the neighborhood. Something must be done to preserve the family -friendly atmosphere of our neighborhood. We do not want that near our homes! The rear exit will spill out onto Woodland Heights, which will encourage people to take a "short cut" down Pleasant Forest Drive or Sierra Forest. This will destroy our neighborhood. I am the principal at Jefferson Elementary School and I have lived on Pleasant Forest Drive for eleven years now. I raised my children in this neighborhood and now have grandchildren who enjoy playing here. The traffic on Pleasant Forest Dr. has steadily increased as well as the speed at which the cars fly over the hill and past my home. This is very dangerous for children playing in the neighborhood. Something must be done to preserve the family -friendly atmosphere of our neighborhood. The proposed Pleasant Ridge development would increase traffic through here and worsen the traffic congestion that already exists. It is my sincere hope that you too possess the strong family values that a community leader of good character must possess to do what is right for communities and neighborhoods like that of Pleasant Forest. I wish to express my opposition to the development in its current form. Among my concerns are: 1) Vehicular traffic flow will increase substantially from its current level in and around the development. While traffic engineers may believe that this will not be a problem, I know from living near Park Plaza for several years that retail traffic presents hazards which don't exist in non -retail areas. The danger is especially acute when school bus stops—of which there are several on the streets adjacent to the proposed development—are forced to coexist with retail traffic. 2) There is insufficient buffer area around the proposed development. An established neighborhood like Pleasant Forest should be well -buffered from new construction such as this. In plans that I have seen, the largest building in the development is the one closest to residential areas. 3) Values for homes in the area (I just moved to my house at the end of June) will be negatively impacted due to the increased traffic and proximity to retail. This is not speculation. Ask people who live near any of the retail developments on West Markham or Chenal Parkway how their property values have held up since those stores became their neighbors. 4) Criminal activity usually increases when large retail stores like the ones in this proposal are operating. Having gone through burglary and identity theft myself, I wish to avoid repeating that experience. I believe the risk would be substantially greater in the presence of this development. 5) In addition to the vehicular issue above, I am concerned that Highway 10/Cantrell Road won't safely support the increase in volume the development represents. This artery is already heavily traveled and congested. The proposed development will exacerbate that congestion. I am not opposed to development per se, and I know that the developer is anxious to maximize this property. Perhaps a smaller version of this development would present a more suitable use for the developer and for the residents of Pleasant Forest.
