A local developer, Lou Schickel, whose company Pleasant Ridge Development, is planning a 27 -acre commercial development on highway 10. This development does not meet any of the city's minimum buffers for commercial development. It is also projected to bring over 14,000 additional cars to an area already suffering from traffic congestion problems now. I do not see how this area will be able to handle an additional 14,000 plus cars per day safely. Pleasant Forest and Pleasant View already have a very serious problem with speeding and heavy traffic flow. We have had a child killed, an adult seriously injured and thousands of dollars in property damage done. Pleasant Forest drive is defined as a collector street by Little Rock Public Works department. Public Works own traffic department studies show that Pleasant Forest is already over it's maximum capacity of 5,000 cars per day. With this center opening up and dumping more traffic into the neighborhoods, it will take already serious speeding and traffic problems and multiply them many times over. This will totally destroy both neighborhoods. It will jeopardize resident's personal safety; destroy property values and property safety. It will increase noise pollution, littering and property crimes as well. There have been two different traffic studies done on this area by both the developer's traffic engineer and the city of Little Rock's traffic engineer. Neither study shows any impact the increased traffic will have on the emergency fire response from Fire Station 16. Fire Station 16 is the first response for Pleasant Forest, Pleasant View, Cedar Branch, Pleasant Valley, Longley, and Pebble Beach neighborhoods for fire protection and emergency care. Station 16 lies on the North side of the Southridge and Hwy 10 intersection, while the neighborhoods lie to the South. This huge development lies between the neighborhoods and their fire protection. This plan is one of the worse examples of "Commercial Creep" I have ever seen. I would hope you would thoroughly examine the plans and think very carefully of the long range impact this commercial development will have on these established neighborhoods and their residents. I love living in Pleasant View and have wonderful neighbors. I would hate for one greedy development company to be allowed to destroy my neighborhood, the surrounding neighborhoods and the quality of life I enjoy here. I have made a major investment in Little Rock and Pleasant View. The Little Rock Public Works Planning Department and the Little Rock Planning Commission have already turned their backs on the residents of these neighborhoods. If the City of Little Rock Board of Directors, city manager and Mayor cannot be trusted to follow Little Rock's own Land Use Plan and zoning, where will "Commercial Creep" end? Will any neighborhood in Little Rock be safe? How will any one be able to purchase a home and have any assurance that a commercial development will not be allowed to change the zoning and move in next door?? I would appreciate your support in voting against this development at the November 9, 2004 agenda meeting. Your vote against this development is a vote for Little Rock residents and neighborhoods. I apologize for the delay in getting this back to you. 2.3 Re-zoning/Spot Zoning: - Page 15, Paragraph 3 When a property is surrounded by property zoned R-2 and rezoned, this type of spot zoning has been suggested by ..... The area in question is not and was not surrounded by R-2, zoned property. To the west of the site are properties zoned R-2. The remaining areas around the site are a variety of zonings including MF -6, 0-3, POD and C-2. Page 16 — The legislative purpose, intent and application of PCD's are spelled out in the City Code, as follows: ... Life Style Centers are designed to encourage clustering of commercial activities within a specific site and to decrease the potential for strip development along streets. The Pleasant Ridge Long - form PCD, a life style center, addresses several of the points in the purpose and intent section of the ordinance. Page 17 — City wholly failed to consider the 25,000 to 50,000 dump truck loads of dirt that will be moved ... The traffic circulation system was discussed in detail at the Planning Commission Public Hearing and the Board of Directors Public Hearing. The discussion of the hauling of the dirt from the site included a plan for moving the dirt from the site. All the loads of dirt were to be removed from the site utilized Highway 10 and prohibiting the removal of the dirt from the site utilizing any City street. Page 21 — In the Case of Lindsey ... At the request of the City a number of traffic studies were undertaken by the Pleasant Ridge Town Center Long -form PCD developer to address the issues of increased traffic and circulation in the area. After review of the studies, City staff made a number of recommendations including relocating and limiting the number of driveway locations and to provide a traffic signal at the main entrance to the development and Cantrell Road. Staff determined with the addition of the traffic signal at this location and with timing adjustments of existing traffic signals, traffic movement would be facilitated in the area. The developer agreed to the recommendations. Page 23 - ... unless it can also require the improvements, needed o the streets and highway ... The developers of Pleasant Ridge Town Center Long -form PCD will provide all boundary street improvements to the abutting roadways per the Master Street Plan. The developer has indicated dedication of right-of-way along Highway 10 per the Master Street Plan requirement. An additional lane will not be added at this time due to safety concerns. Page 24 — Declaration Judgment ... The review by the Planning Commission included the proposed cut along the western portion of the development. The Planning Commission and the Board of Directors were well aware of the proposed cut of the hill when reviewing the request. Little Rock Wastewater did provide comments to City staff concerning the proposed request. Wastewater commented, Sewer main extension required with easements, if service is required for the project. Although, the site included a reduced landscape strip along Cantrell Road less than typically required by ordinance, the procedure for relief from the Highway 10 Design Overlay District is to request a Planned Development Zoning classification. The Planned Development Zoning classification is not bound by the Zoning Ordinance. The Zoning Ordinance is used to establish typical minimum requirements. The same is true of buffer requirements. Although, the southern buffer is approximately 500 square feet less than the typical minimum ordinance requirement, the reduced southern buffer area is located adjacent to an athletic practice field, office development and a church. The southwestern buffer area was increased were adjacent to residentially used properties. Through the Planning Zoning District process, other developments in the area have been approved with reduced buffers. The buffer area was increased in areas more critical, such as adjacent to the residentially used properties. As for the number of parking spaces, the Zoning Ordinance sets out typical minimum parking ratios based on usage. Typically, parking lots are sized to accommodate the maximum number of cars that a development could generate, which usually only occurs two to three times during the year, between Thanksgiving and Christmas. The proposed development provides 1200 parking spaces 133 less than the typical ordinance standard. As previously indicated there was a great deal of discussion concerning the proposed dump trucks and the loads of dirt. The Wastewater Department provided comments concerning the proposed development and did not indicate the development would have any adverse impact on the City's wastewater system. The applicant provided traffic studies, which did project future traffic patterns in the area and future traffic growth. The Planning Commission discussion focused on the area traffic and potential growth and increased traffic in the area. The City did adhere to their zoning criteria. The Planned Unit Development zoning classification is the proper way to seek relief from various ordinance requirements. The applicant and the City followed its own procedure for review and approval of the request. The Planning Commission By-laws require a sign to be posted on the site. The Pleasant Ridge Town Center Long -form PCD was considered one development site. Only one sign was required to be posted on the site. Summit Road was reviewed as a part of the Pleasant Ridge Town Center Long -form PCD application. In the past, Staff has allowed the Planned Development notice sign to serve as notice of all proposed action. Typically, if there is to be a right-of-way abandonment filed independent of a Planned Development zoning request, a sign to notify persons of the closure is posted for the right-of-way in question. Page 25 — 2.5 Failure to adhere to Established Zoning Criteria. Procedures were followed. The applicant filed for a PCD to allow the development of a Life Style Center. The concept of a Life Style Center discourages the proliferation of commercial uses along major thoroughfares and noncommercial areas. The design of the development is such that areas are set aside for increased landscaping and pedestrian tables were added to the site to allow for safe pedestrian circulation through the site. In addition, increased landscaping was added to the southwestern perimeter of the site to further screen the residentially zoned properties. The City's Future Land Use Plan was indicated as Commercial and Suburban Office but was amended to Mixed Use on the same agenda as the rezoning request. The scale of the development was considered as well as the treatment of the buildings and other elements to ensure compatibility with the area. The architectural design of the buildings will be constructed as to break the long expanses of walls and provide architectural features in the design. Page 28 — Bullet Points a. The approved site plan includes the placement of an undisturbed buffer along the southwestern portion of the site. The applicant has also agreed to increase the landscaping in this area and provide an architectural wall to screen the site from the adjoining residential properties and properties owned by the Jewish Center. b. The increased traffic was discussed in great detail at the Public Hearings held by the Little Rock Planning Commission and the Board of Directors. c. Traffic studies were provided by the Developer and reviewed by the City Traffic Engineer concerning the proposed traffic and congestion in the area. The developer has indicated a traffic signal will be placed at the entrance to the development, which should facilitate existing and future traffic movement through the area. Page 47 — 2.7 Violation of By-laws of the Planning Commission. The applicant is required by the Planning Commission By-laws to post a sign on the development site at a minimum of 30 days prior to the public hearing. The development sign was posted on the site adjacent to Cantrell Road. Per the By-laws the applicant is not required to post a sign on all street sides nor on all affected parcels. The sign posted was a 4 -foot by 4 -foot sign as required by the By-laws. At the request of staff, based on numerous phone calls from area residents and patrons of nearby businesses, the applicant agreed to place a sign on the rear of the site. The placement of the sign on the rear of the property was not a requirement of the By-laws. The property owned by Christ the King was not being considered for rezoning. The applicant's request included advanced grading on this site. There is not a requirement for the placement of signage for issues dealing with the Land Alteration Ordinance. I believe it is 27 acres, or 300,000 square feet, and over a million cubic feet of earth. Please put me down on the opposed side of this issue. Hillside removal is exactly what the Land Alteration Task Force tried to prevent during their labors to assure that LR would be developed preserving the integrity of the land. When the hillside on West Markham @ Chenal was removed in order to construct the Target store in 1996, it caused such a fuss among the populace that this Task Force of civic volunteers was appointed by the City. If you remember, the ordinance changes we were able to attain were hard won after much deliberation with Task Force members and Developers/Engineers deciding what each side would accept. Most importantly, these ordinances, to quote one of those developers, were the MINIMUM STANDARD for the City. These ordinances were passed by the Board of Directors by a unanimous vote. This development in question will set a precedence for the remaining developments for the City as Little Rock grows further to the west, into the hills. If permission is granted this development as proposed and further variances are permitted, the ordinances will no longer be effective. To allow this type of hillside removal would be a step backward for the City and an insult to all those who worked so hard at attaining a higher standard for the City with stricter ordinances. It is noteworthy that Mizan Rahman, Bob Turner, and Troy Laha all worked/consulted on the excavation part of these ordinance changes. It is time for those concerned with reaping financial benefits from developing land in Little Rock to realize that "the way it has always been done" is no longer acceptable for the good of the city. Many quality developers have already moved into this new mode, and it is time now for Little Rock to catch up with the rest of the United States and expect only the best, leaving intact our enviable natural beauty we are blessed with.
